Taysir Masa'il al-Fiqh Sharh al-Rawd al-Murabba (Arabic: تيسير مسائل الفقه شرح الروض المربع) is a contemporary commentary on Hanbali jurisprudence by Abd al-Karim al-Namlah (d. 1435 AH / 2014 CE), expanding upon Mansur al-Bahuti's (1000–1051 AH / 1591–1641 CE) classical legal manual al-Rawd al-Murabba .
Composition and Purpose
The work was completed on 28 Dhu al-Qi'dah 1426 AH (December 2005 CE) by Abd al-Karim ibn Ali ibn Muhammad al-Namlah, a professor at the College of Sharia in Riyadh . The author gave the book the extended title Taysir Masa'il al-Fiqh: Sharh al-Rawd al-Murabba wa-Tanzil al-Ahkam 'ala Qawa'idiha al-Usuliyyah wa-Bayan Maqasidiha wa-Masalihiha wa-Asrariha wa-Asbab al-Ikhtilaf Fiha .
Al-Namlah undertook the work because of the comprehensive range of practical legal issues and branch rulings contained in al-Bahuti's text . His stated aim was to simplify the expressions of al-Rawd al-Murabba', link every substantive legal ruling (hukm) directly to its underlying principle of legal theory (qa'idah usuliyyah), elucidate the legislative objective (maqsad) behind each ruling—specifically in terms of securing benefits (jalb maslahah) or repelling harms (daf' mafsadah)—and clarify the causes and reasons for juristic disagreement (asbab al-ikhtilaf) wherever possible .
Structure
The work is organized into numbered legal issues across five volumes:
- Volume 1: Covers the initial chapters of jurisprudence and concludes with the chapter on the prayer of people with valid excuses, shortening and combining prayers, and the fear prayer (Salat Ahl al-A'dhar wa Qasr al-Salat wa Jam'iha wa Salat al-Khawf) .
- Volume 2: Opens with the chapter on Friday prayer (Salat al-Jumu'ah) and concludes with the chapter on the protection pact and its rulings (Aqd al-Dhimmah wa Ahkamuha), the final section of the Book of Jihad (Kitab al-Jihad) .
- Volume 3: Commences with the Book of Sales (Kitab al-Bay') and concludes with the Book of Endowments (Kitab al-Waqf) .
- Volume 4: Begins with the chapter on gifts and donations (al-Hibah wa al-'Atiyyah wa al-Hadiyyah) and ends with the chapter on child custody and guardianship (Hadanat wa Kafalat al-Tifl), which concludes the Book of Maintenance and Custody (Kitab al-Nafaqat wa al-Hadanah) .
- Volume 5: Opens with the Book of Felonies (Kitab al-Jinayat) and ends with the Book of Acknowledgments (Kitab al-Iqrar) .
