Tanqih al-Munazara fi Tashih al-Mukhabara (Refining the Debate on Validating Agricultural Sharecropping) is a legal treatise on comparative jurisprudence concerning sharecropping (al-muzara'a and al-mukhabara), written by the Shafi'i jurist and chief judge Badr al-Din Ibn Jama'ah (639–733 AH / 1241–1333 CE) .

Composition and Purpose

According to the author's note on the original manuscript, Ibn Jama'ah compiled the work in Rajab 683 AH . He stated in his introduction that he composed it in response to a directive from an authority whose obedience was obligatory, seeking to clarify the legal status and conflicting scholarly opinions on sharecropping due to the public's widespread practical need for it . Ibn Jama'ah observed that landowners often cannot cultivate their own land, while agricultural workers often do not own land, making legal contracts that balance both parties' mutual interests necessary .

Structure and Method

Ibn Jama'ah adopts a concise comparative approach, omitting full chains of transmission (isnad) while detailing the arguments and textual evidence of the Companions, Successors, and the four Sunni legal schools . The treatise is structured around several core topics:

  1. Linguistic Definitions: The linguistic origins of al-muzara'a and al-mukhabara, evaluating various proposed derivations—such as derivation from al-khabar (soft land), the transaction of Khaybar, or al-khubra (a defined share)—and explaining his preferred etymology .
  2. Technical Juristic Definitions: The technical legal distinctions between muzara'a and mukhabara, discussing whether the two terms are synonymous or whether they differ based on which party provides the seed .
  3. Invalid Forms by Consensus: Sharecropping contracts that are universally agreed to be invalid (batila bi-l-ijma'), supported by textual proofs and illustrative cases, such as contracts stipulating that the output of a specific, demarcated plot of land belongs exclusively to one party .
  4. Disputed Forms and Legal Reasoning: An examination of disputed forms of sharecropping, categorized into three scholarly positions: absolute permissibility, absolute prohibition, and differentiation based on who supplies the seed .

Throughout the work, Ibn Jama'ah defends the validity of sharecropping contracts based on prophetic evidence, such as the Prophet's transaction with the people of Khaybar, thereby departing from the standard ruling of his own madhhab's founder, Imam al-Shafi'i, who disallowed standalone muzara'a .

Transmission and Modern Editions

Manuscripts of the work preserve historical audition records (sama'at) and readings before the author:

  • A transmission recorded by 'Abd Allah ibn Muhammad ibn Muhammad ibn Abi Bakr al-Tabari al-Makki through the reading of his son Ahmad .
  • An audition in Rabi' al-Thani 705 AH involving the hadith scholar Najm al-Din Abu Bakr ibn Muhammad ibn Yahya al-Wasiti and a group of listeners, concluding with a general license (ijaza) from Ibn Jama'ah .
  • A reading by 'Umar ibn 'Ali al-Damanhuri dated 16 Dhu al-Hijjah 713 AH, in which Ibn Jama'ah also granted an ijaza .

The book is cited in classical biographical and bibliographical registers, including Barnamaj Ibn Jabir, Taj al-Mafriq by al-Balawi, al-Uns al-Jalil by Mujir al-Din al-Hanbali, Idah al-Maknun, and Hadiyyat al-'Arifin .

In modern times, the treatise was edited by Dr. Abd al-Salam ibn Salim al-Suhaymi and published in the journal of the Islamic University of Madinah . It was also edited by Dr. Ali Azzouz and published by Dar Ibn Hazm in 1427 AH / 2006 CE .
