Sharh Manzumat al-Qawaid al-Fiqhiyya is a contemporary commentary by Hamad ibn Abd Allah al-Hamad on the didactic poem on Islamic legal maxims (al-qawa'id al-fiqhiyya) composed by Abd al-Rahman ibn Nasir al-Sa'di (d. 1376 AH / 1956 CE) .
Origin and Scope
The work originated as a series of educational lectures delivered during an intensive scholastic course held in the State of Qatar . The recorded audio lessons were subsequently transcribed and published in written form by the Islamweb network (al-Shabakah al-Islamiyyah) . The commentary is dedicated to unpacking al-Sa'di's verse treatise, which gathers concise yet comprehensive legal maxims essential for students of jurisprudence .
Method and Contents
Al-Hamad begins the work with an introductory discourse clarifying fundamental terminological distinctions within Islamic jurisprudence :
- The linguistic definition of a principle or foundation (al-qa'idah) .
- The differences between legal maxims (al-qawa'id al-fiqhiyya), legal constraints (al-dawabit), jurisprudential methodology principles (al-qawa'id al-usuliyya), and school-specific maxims (al-qawa'id al-madhhabiyya, such as those specific to the Hanbali, Shafi'i, Maliki, or Hanafi legal traditions) .
Following the conceptual introduction, the author proceeds sequentially through the lines of the poem, explaining individual verses and elucidating their substantive legal applications . This includes central universal rules such as the foundational principle that the Islamic legal system is constructed entirely upon realizing and maximizing benefits while repelling and minimizing harms, as well as the rules governing prioritized selection when competing benefits or harms conflict .
