Idah al-Masalik ila Qawaid al-Imam Malik (Elucidation of the Paths to the Legal Maxims of Imam Malik) is a specialized treatise on Maliki legal maxims (qawaʿid fiqhiyya) by the North African jurist Abu al-Abbas Ahmad ibn Yahya al-Wansharisi (834–914 AH / 1430–1508 CE) . The work gathers core legal maxims of the Maliki school and systematically demonstrates how substantive legal rulings and intra-school differences of opinion derive from them .
Background and Composition
Al-Wansharisi states in the introduction that he composed the book in response to a request from an esteemed correspondent who asked for a refined, well-ordered summary of legal maxims that would be easy to grasp and study . Despite mentioning personal hardship, distress, and divided concentration at the time, he agreed to fulfill the request and named the resulting compilation Idah al-Masalik ila Qawaid al-Imam Abi Abd Allah Malik .
Content and Methodology
The work extracts and synthesizes material scattered across dozens of foundational reference works of Maliki jurisprudence . Under each legal maxim, al-Wansharisi gathers a wide array of substantive legal branches (furuʿ) and contentious legal applications (masaʾil al-khilaf), tracing differing juristic viewpoints within the school back to their foundational maxims .
While the majority of the maxims in the book deal with disputed or branched rules of jurisprudence, only around seventeen represent universally agreed-upon declarative maxims—such as "repelling harms takes precedence over procuring benefits" and "necessities render prohibited things permissible" .
Among the author's primary sources are the Qawaʿid of Abu Abd Allah Muhammad ibn Muhammad al-Maqqari, Anwar al-Buruq fi Anwa al-Furuq by Shihab al-Din al-Qarafi, the Mukhtasar of Ibn al-Hajib, and al-Tawdih by Khalil . A noted critical observation regarding al-Wansharisi's methodology is that he frequently incorporated maxims and examples verbatim—especially from al-Maqqari's Qawaʿid—without explicit citation . His phrasing in the body of the work is notably condensed, demanding careful analysis to decipher the underlying legal applications .
Adaptations and Editions
Idah al-Masalik generated scholarly interest and subsequent treatments:
- The author's son, Abd al-Wahid ibn Ahmad al-Wansharisi (d. 955 AH), versified and summarized it in rajaz meter under the title al-Nur al-Muqtabas min Qawaid Madhhab Malik ibn Anas, adding further examples and maxims drawn largely from Ibn Arafa's al-Mukhtasar al-Kabir .
- Muhammad al-Sadiq al-Shatti al-Tunisi later abridged and edited the text .
In modern scholarship, the book was edited by Ahmad Bu Tahir al-Khattabi and published in Rabat (1400 AH / 1980 CE) under the auspices of the Joint Moroccan-UAE Heritage Committee . It was also edited by al-Sadiq al-Ghiryani and published in Tripoli in 1991, who additionally authored a dedicated study analyzing its juristic applications titled Tatbiqat Qawaid al-Fiqh inda al-Malikiyya min Khilal Idah al-Masalik .
