Abu al-Abbas al-Wansharisi (c. 834–914 AH / c. 1430–1508 CE) was a North African Maliki jurist, mufti, and legal scholar based in Tlemcen and later in Fez, renowned for his monumental compendium of Islamic legal opinions, al-Mi‘yar al-Mu‘rib .
Origin and Upbringing
His full lineage is Ahmad ibn Yahya ibn Muhammad ibn Abd al-Wahid ibn Ali al-Wansharisi . His nisba derives from the mountainous region of Ouarsenis (Wansharis), which was his ancestral home and likely place of birth, though some sources describe him as originating directly from Tlemcen . He was raised and educated in Tlemcen, where he mastered Islamic jurisprudence, legal theory, Arabic grammar, rhetoric, and inheritance law . His teachers in Tlemcen included eminent scholars such as Abu al-Fadl Qasim al-Uqbani, his son Abu Salim, Ibn Marzuq al-Kafif, Muhammad ibn al-Abbas, Abu Abd Allah al-Jallab, and Ahmad ibn Zakri .
Relocation to Fez and Teaching
Al-Wansharisi served as a teacher and mufti in Tlemcen until 874 AH (1469 CE), when a political conflict arose with the local Zayyanid ruler, who ordered his house ransacked and looted . Al-Wansharisi fled westward to Fez, where he settled near the al-Qarawiyyin mosque and was granted safety . In Fez, he attended the circles of local figures such as the judge Muhammad ibn al-Ghardis and benefited extensively from the city's private and institutional manuscript libraries .
He initially taught in local mosques, including the suspended mosque of al-Sharatin, before being appointed to an endowed teaching chair for al-Mudawwana at the al-Misbahiyya Madrasa . His instruction drew large audiences of students, and among his notable pupils were his son Abd al-Wahid al-Wansharisi, Muhammad ibn Abd al-Jabbar al-Wartadghiri al-Fijiji, Abu Zakariyya al-Susi, and Muhammad ibn Isa al-Maghili .
Scholarly Standing
Biographers regarded al-Wansharisi as the foremost standard-bearer of the Maliki school at the turn of the ninth Islamic century, praising his deep command of substantive law and legal differences . He was noted for his uncompromising adherence to legal principles in the face of political authorities . His most celebrated work is al-Mi‘yar al-Mu‘rib wa-al-Jami‘ al-Mughrib ‘an Fatawa Ahl Ifriqiyya wa-al-Andalus wa-al-Maghrib ("The Clear Standard and Western Compendium on the Fatwas of the Scholars of Ifriqiya, al-Andalus, and the Maghrib"), an extensive multi-volume compilation that gathered hundreds of legal responsa from foundational and later jurists of the western Islamic lands . He also authored Idah al-Masalik ila Qawa‘id al-Imam Malik ("Elucidation of the Paths to the Legal Maxims of Imam Malik"), which systematically arranged the maxims underpinning Maliki jurisprudence, as well as Asna al-Matajir, a legal treatise arguing for the strict obligation of Muslims to emigrate from Christian-ruled territories in the Iberian Peninsula .
Death
Al-Wansharisi died in Fez in the month of Safar 914 AH (1508 CE), having reached approximately eighty years of age .
