Dalalat al-Iqtiran wa Wajh al-Ihtijaj biha inda al-Usuliyyin (دلالة الاقتران ووجه الاحتجاج بها عند الأصوليين; The Indication of Conjunction and the Manner of Arguing by It Among Legal Theorists) is a contemporary treatise on usul al-fiqh (principles of Islamic jurisprudence) written by the Egyptian scholar Abu Asim al-Barakati (al-Shahhat Sha'ban Mahmud Abd al-Qadir) . The work is dedicated to examining the juristic validity of dalalat al-iqtiran—the interpretive rule concerning whether multiple items joined together in a single textual command or prohibition share the same legal ruling .
Composition and Publication
The author completed the treatise on Monday, 19 Jumada al-Akhirah 1429 AH (23 June 2008 CE) . The initial idea for the research was suggested and overseen by Shaykh Wahid ibn Abd al-Salam Bali, who guided its preparation and reviewed the draft . It was also reviewed by Shaykh Abu Hafs Sami ibn al-Arabi al-Athari, who provided remarks and revisions .
The first edition of the book was published in 1432 AH / 2011 CE by Dar al-Nashr wa-al-Tawzi' al-Islamiyyah .
Scope and Contents
The book investigates the theoretical disagreement among Islamic legal theorists regarding dalalat al-iqtiran: while some scholars have employed it as an acceptable method of textual deduction, the majority (al-jumhur) reject it and consider it a weak form of evidence . The author emphasizes linking theoretical usul principles with practical legal applications (al-tatbiq al-fiqhi) to prevent legal theory from becoming disconnected from practical jurisprudence .
The treatise is organized around the following research topics:
- Linguistic and technical definitions of dalala (textual indication) and iqtiran (conjunction) .
- The formal technical definition (al-ta'rif al-laqabi) of dalalat al-iqtiran, defined as combining two or more entities within a command or prohibition, clarifying the ruling for one of them, and inferring the same ruling for the other by virtue of their conjunction .
- Practical juristic examples illustrating where scholars have invoked this indication .
- Scholarly stances and arguments on dalalat al-iqtiran .
- An analysis of the coordinating particle waw (waw al-'atf) and its linguistic usage .
- Conjoining a recommended act to an obligatory one ('atf al-sunnah 'ala al-wajib) .
- Typologies of conjunctional indication, distinguishing between the forms that can legitimately serve as legal proof and those that cannot .
- Applied juristic rulings (tatbiqat fiqhiyyah) in which jurists relied on dalalat al-iqtiran, accompanied by critical analysis .
- A summary of findings (Khulasat al-bahth) and the concluding remarks .
Reception
In his written introduction, Wahid ibn Abd al-Salam Bali commended the book for its expanded analysis, lucid style, and clarity of expression, singling out its emphasis on applied fiqh case studies and its evaluation of which applications are valid and which are invalid . Sami ibn al-Arabi al-Athari likewise praised the research in his preface dated 19 Jumada al-Ula 1432 AH (22 April 2011 CE), noting the necessity of clarifying when dalalat al-iqtiran serves as an authoritative proof and when it fails to do so .
