al-Taqrir wa al-Tahbir ala Kitab al-Tahrir (The Confirmation and Embellishment upon the Book of Verification) is a classical commentary on Islamic legal theory (usul al-fiqh) composed by the Hanafi jurist and scholar Ibn Amir Hajj (825–879 AH / 1422–1474 CE) .
Background and Composition
The work is an extensive commentary on al-Tahrir fi Usul al-Fiqh, an influential manual authored by Ibn Amir Hajj’s teacher, Ibn al-Humam (d. 861 AH / 1457 CE) . Ibn al-Humam’s base text was organized into an introduction and three discourses (maqalat), synthesizing the terminology and doctrinal traditions of both the Hanafi and Shafi'i schools in an exceptionally condensed style .
Ibn Amir Hajj records in his preface that while studying al-Tahrir directly under Ibn al-Humam, the latter made repeated suggestions that he write a commentary on it . He began drafting the commentary and eventually traveled to meet Ibn al-Humam in order to fulfill his duty of visiting him, incorporate subsequent revisions his teacher had added to the text, and submit his commentary for review . However, Ibn al-Humam died shortly after his arrival . Grief-stricken, Ibn Amir Hajj suspended the project for years until peers repeatedly urged him to resume it . He completed the work by adopting a balanced methodology between conciseness and elaboration .
Method and Scope
The commentary is composed as a blended text (sharh mamzuj), weaving Ibn al-Humam’s original statements directly into the explanatory prose . It unpacks the condensed formulations of the root text, resolves subtle ambiguities, articulates the underlying evidential bases, and elucidates the theoretical divergences between the jurists of the Hanafi tradition and the Shafi'i legal theorists .
Hajji Khalifa states that Ibn Amir Hajj finished the work in Ramadan 871 AH . A manuscript colophon preserved from the author’s original draft indicates that the fair copy of the second volume was completed at al-Madrasah al-Halawiyyah in Aleppo on Sunday afternoon, 21 Rabi' al-Awwal 873 AH .
Reception and Editions
al-Taqrir wa al-Tahbir is regarded as one of the fundamental commentaries on Ibn al-Humam's al-Tahrir, alongside the later commentary Taysir al-Tahrir by Amir Badshah al-Bukhari (d. 972 AH) . The text has been published in three volumes .
