al-Muhadhdhab fi Ilm Usul al-Fiqh al-Muqaran (The Refined in Comparative Legal Theory) is a five-volume treatise on comparative Islamic jurisprudence and legal methodology by the Saudi scholar Abd al-Karim al-Namlah (d. 1435 AH / 2014 CE) .

Composition and Purpose

The full title given by the author is al-Muhadhdhab fi ʿIlm Usul al-Fiqh al-Muqaran: Tahrir li-Masaʾilihi wa-Dirasatuha Dirasatan Nazariyyatan Tatbiqiyyah (The Refined in Comparative Legal Theory: An Editing of Its Issues and Their Theoretical and Applied Study) . Al-Namlah completed the manuscript on Monday evening, 27 Rajab 1419 AH (1998 CE), in Riyadh, while serving as a professor in the Department of Usul al-Fiqh at the Faculty of Sharia at Imam Mohammad Ibn Saud Islamic University .

Al-Namlah composed the work in response to requests from students seeking a comprehensive reference that collected the issues of legal theory in an accessible, modern style, illustrated with practical legal applications, without partisanship toward any specific legal school (madhhab) . He noted that many students avoided the subject due to complex terminology, lack of applied examples, and obscurity of purpose; he therefore set out to refine (tahdhib) the discipline by eliminating extraneous or unbeneficial debates and rendering difficult concepts straightforward .

Structure

The treatise is organized systematically into seven major divisions (abwab), each subdivided into chapters (fusul), sections (mabahith), subsections (matalib), specific issues (masa'il), and discrete points (nuqat) :

  • Book 1: Preliminaries (al-Muqaddimat), encompassing foundational principles, the definition, origins, and benefits of legal theory, as well as essential terminology .
  • Book 2: Legal Rulings and Moral Responsibility (al-Hukm al-Sharʿi wa-l-Taklif bihi) .
  • Book 3: Proofs of Legal Rulings (Adillat al-Ahkam al-Sharʿiyyah), covering both agreed-upon and contested textual and rational sources .
  • Book 4: Textual Expressions and Their Significations (al-Alfaz wa-Dalalatuha ʿala al-Ahkam) .
  • Book 5: Analogy (al-Qiyas) .
  • Book 6: Independent Juristic Reasoning and Conformity (al-Ijtihad wa-l-Taqlid) .
  • Book 7: Conflict, Reconciliation, and Preference (al-Taʿarud wa-l-Jamʿ wa-l-Tarjih) .

Methodology

Al-Namlah drew upon both classical and contemporary treatises across the four major Sunni schools: Hanafi, Maliki, Shafi'i, and Hanbali . His methodology followed explicit analytical steps:

  1. Definition and Clarification: Defining legal terms linguistically and technically, choosing the most sound definitions, and clearly framing each issue along with its point of contention (tahrir mahall al-nizaʿ) .
  2. Comparative Presentation: Setting forth the various doctrines and scholarly positions, beginning with the author's preferred position (al-madhhab al-rajih), presenting its strongest proofs, and directly answering potential objections . He then detailed the dissenting views along with their arguments and addressed each sequentially .
  3. Nature of Disagreement and Application: Examining whether disagreements among jurists were substantive (maʿnawi) or merely verbal (lafzi), establishing proofs for either characterization, and outlining the resulting practical jurisprudence (furuʿ) .
  4. Hierarchy of Evidence: Establishing theoretical legal maxims primarily through the consensus of the Companions, followed by direct texts of the Quran and the Sunnah, the rational purport of texts, analogy, and other valid proofs .

Publication and Reception

al-Muhadhdhab was published in five volumes by Maktabat al-Rushd in Riyadh, with its first edition appearing in 1420 AH / 1999 CE . Al-Namlah used the work, alongside his eight-volume commentary Ithaf Dhawi al-Basa'ir, in teaching undergraduate and postgraduate students at the Faculty of Sharia, the Higher Institute of Judiciary (al-Maʿhad al-ʿAli li-l-Qada'), and the College of Education for Girls in Riyadh .
