al-Mankhul min Taliqat al-Usul (The Sifted from the Notes on Legal Theory) is an early treatise on Islamic jurisprudence (usul al-fiqh) by Abu Hamid al-Ghazali (d. 505 AH / 1111 CE) . It summarizes and arranges the legal theories and lecture notes of his teacher, Imam al-Haramayn al-Juwayni (d. 478 AH / 1085 CE) .

Composition and Reception

al-Ghazali wrote al-Mankhul during his student years in Nishapur while studying under al-Juwayni . In the book's epilogue, al-Ghazali states that the work distills the notes (ta'aliq) of al-Juwayni by removing superfluous discussions, avoiding excessive length, and adhering strictly to his master's formulations and reasoning without altering their meaning, while reorganizing the material into systematically divided chapters and sections to facilitate study and reference . Later scholars, such as Hasan al-Attar (d. 1250 AH), regarded al-Mankhul as essentially an abridgment of al-Juwayni's major work on legal theory, al-Burhan fi Usul al-Fiqh .

Biographical sources report that when al-Ghazali completed the book and presented it to al-Juwayni, his teacher remarked: "You have buried me while I am alive; could you not have waited until I died? For your book has eclipsed mine" .

Method and Doctrinal Positions

Representing the early stage of al-Ghazali's scholarly career, al-Mankhul closely adheres to al-Juwayni's doctrinal positions rather than the independent views al-Ghazali adopted later in life . For example, regarding two conflicting legal causes where one maintains an existing default ruling (al-illah al-muqarrirah) and the other transfers away from it (al-illah al-naqilah), al-Ghazali followed al-Juwayni in al-Mankhul by preferring the confirming cause; in his mature work al-Mustasfa min Ilm al-Usul, al-Ghazali reversed his stance and gave precedence to the transferring cause .

The text also contains critical examinations of competing methodologies, including sharp evaluations of Abu Hanifa's legal reasoning . Anticipating criticism that he was excessively biased toward al-Shafi'i, al-Ghazali wrote at the end of the text that his analysis was objective and economical, calling upon the reader to set aside uncritical imitation and examine the foundational rules with an open mind .

Place in al-Ghazali's Works and Editions

al-Mankhul is al-Ghazali's earliest legal theory book, preceding his later treatises Shifa al-Ghalil, Tahdhib al-Usul, and al-Mustasfa . When introducing al-Mustasfa, al-Ghazali noted that students had requested a work intermediate in length—longer than al-Mankhul but shorter than Tahdhib al-Usul .

The work has been edited and published in modern times with annotations by Muhammad Hasan Hito .
