al-Hukm min al-Muamalat wa al-Mawarith wa al-Nikah wa al-Atima fi Ayat al-Quran al-Karim ("The Underlying Wisdoms in Financial Transactions, Inheritance, Marriage, and Foods in the Verses of the Noble Quran") is an academic study in thematic Quranic exegesis by Abu Bakr ibn Muhammad Fawzi .
Composition and Purpose
The work was prepared as a master's thesis under the academic supervision of Abdullah ibn Muhammad al-Amin al-Shinqiti during the 1427–1428 AH academic year . The author framed the work as an inquiry within thematic exegesis (al-tafsir al-mawdu'i), aiming to deduce the underlying divine wisdoms (al-hikam) intended by the Lawgiver for the individual and the community, drawing upon the methods of Quranic commentators and jurists . The selection and sequence of the four legal areas—financial transactions, inheritance, marriage, and dietary laws—were modeled directly after the chapter arrangement adopted by the Hanbali jurist Ibn Qudamah in his legal primer Umdat al-Fiqh .
Structure and Methodology
The author gathers the relevant Quranic verses for each of the four areas and extracts their immediate and deferred wisdoms from both their explicit (mantuq) and implied (mafhum) meanings, relying heavily on classical and modern works of exegesis . To avoid excessive footnotes, Quranic citations are attributed directly within the main text .
The study consists of an introduction, a preliminary chapter, three main parts, and a conclusion :
- Preliminary Chapter (al-Tamhid): Discusses the ultimate purpose of divine accountability (al-taklif) and the benefits of understanding the wisdoms behind Islamic legislation .
- Part One: Examines the moral and spiritual development of the Muslim individual across the four topics, covering themes such as God-consciousness (taqwa), God's watchful awareness (muraqabah), submission to divine decree, and abstaining from prohibited practices .
- Part Two: Explores the cultivation and reform of the Muslim society, addressing justice, kinship ties, mutual benevolence, social solidarity, and the preservation of rights and chastity within transactions, inheritance, marriage, and foods .
- Part Three: Analyzes legal facilitation and the alleviation of hardship (al-taysir wa raf' al-haraj) in each domain, such as leniency toward debtors, the permissibility of divorce, resolving domestic disputes, and concessions for necessities in dietary intake .
The work concludes with findings and recommendations, followed by indices for Quranic verses, prophetic traditions, biographical figures, references, and subject topics .
