Taj al-Din al-Fakihani (654–734 AH / 1256–1334 CE) was an Alexandrian Maliki jurist, grammarian, and hadith scholar, best known for his legal commentary Riyad al-Afham and his treatise against the celebration of the Prophet's birthday, al-Mawrid fi Amal al-Mawlid.
Lineage and education
He was Abu Hafs Taj al-Din Umar ibn Abi al-Yumn Ali ibn Abi al-Naja Salim ibn Sadaqa al-Lakhmi al-Iskandari, commonly known as al-Fakihani or Ibn al-Fakihani. He was born in Alexandria in 654 AH (1256 CE), though a variant report places his birth in 656 AH.
Al-Fakihani studied jurisprudence, hadith, and Arabic language under several prominent scholars. His teachers included Ibn Daqiq al-Iyd, Badr al-Din Ibn Jama'ah, Ibn Tarkhan—from whom he heard al-Qadi Iyad's al-Shifa and the collection of al-Tirmidhi—as well as Atiq al-Umari, Abu Ali al-Bijai, and the Sufi master Abu al-Abbas al-Mursi.
Scholarly career and travels
Al-Fakihani developed expertise across multiple disciplines, combining legal reasoning in the Maliki school with Arabic philology, legal theory (usul al-fiqh), and hadith analysis. He authored al-Tahrir wa-l-Tahbir, a comprehensive commentary on the Risala of Ibn Abi Zayd al-Qayrawani. In his hadith commentary Riyad al-Afham fi Sharh Umdat al-Ahkam, he focused on deducing legal rulings from prophetic traditions alongside fine points of Arabic grammar. He also engaged in theological and legal debates, writing al-Mawrid fi Amal al-Mawlid to argue that the seasonal celebration of the Prophet's birthday was an unjustified religious innovation.
In 731 AH, al-Fakihani traveled eastward, visiting Damascus before performing the Hajj pilgrimage. During his stay in Damascus, he taught and transmitted his writings. Among those who attended his gatherings was Ibn Kathir, who praised him as an erudite master of diverse sciences (dhu funun) distinguished in Maliki jurisprudence and grammar. His companion Jamal al-Din Abd Allah ibn Hadidiyyah recounted that while in Damascus, al-Fakihani visited the relic of the Prophet's sandal preserved at Dar al-Hadith al-Ashrafiyya, uncovering his head, kissing the relic, and weeping with emotion. Among his other students and licensees was Abd al-Wahhab al-Qarawi.
Death
After completing his pilgrimage, al-Fakihani returned to Alexandria, where he died in 734 AH (1334 CE), specifically in Jumada al-Ula or Jumada al-Akhira; other accounts place his death in 731 AH. When news of his passing reached Damascus, an absentee funeral prayer was held for him there.
