Usul al-Sarakhsi (Arabic: أصول السرخسي), also known as Tamhid al-Fusul fi al-Usul (تمهيد الفصول في الأصول; Paving the Chapters in Legal Theory), is a foundational work on Islamic legal theory (usul al-fiqh) according to the Hanafi school, authored by Shams al-A'imma al-Sarakhsi (d. 483 AH / 1090 CE) .

Composition and Purpose

Al-Sarakhsi began dictating the book from memory on Saturday, at the close of Shawwal 479 AH, from a corner of the fortress where he was imprisoned in Uzjand . According to another report, he was imprisoned in Khwarazm and, upon reaching the section on conditions (bab al-shurut), was released and traveled to Fergana, where he completed the dictation .

In his introduction, al-Sarakhsi stated that after completing his dictation of the commentary on the legal works of Muhammad ibn al-Hasan al-Shaybani, he deemed it necessary to elucidate the underlying methodological principles (usul) upon which his legal commentary had been constructed . He noted that mastering these legal principles serves as an aid for students to comprehend the reality of substantive law rulings (furu'), remarking that foundational principles are finite while new legal occurrences are continuous .

Method and Contents

The work is composed according to the method of the Hanafi jurists (tariqat al-fuqaha), which establishes legal theory by formulating rules that align with the transmitted legal cases and rulings of early school authorities such as Abu Hanifa, Abu Yusuf, and al-Shaybani .

Al-Sarakhsi opens the substantive discussions with commands and prohibitions (al-amr wa-al-nahy), emphasizing that they represent the primary medium of legal obligation and the basis for distinguishing lawful from unlawful matters . The book systematically treats linguistic and textual categories—such as general and specific expressions (al-'amm wa-al-khass), literal and metaphorical meanings, and qualified and unqualified rulings—as well as the primary sources of law, consensus (al-ijma'), transmissions (al-akhbar), and analogical reasoning (al-qiyas) .

Reception and Editions

Usul al-Sarakhsi is regarded as one of the primary references in Hanafi jurisprudence, running parallel to Kanz al-Wusul ila Ma'rifat al-Usul by his contemporary Fakhr al-Islam al-Bazdawi (d. 482 AH) . Together, the two texts refined and standardized the Hanafi legal tradition to such an extent that subsequent jurists cited an agreement between both authors with the phrase "the two shaykhs agreed upon this position" . Al-Sarakhsi's work is distinguished by its accessible prose, expansive phrasing, and detailed analysis compared to al-Bazdawi's treatise .

The text was edited by Abu al-Wafa al-Afghani and published by Lajnat Ihya' al-Ma'arif al-Nu'maniyya in Hyderabad (Deccan) in two volumes, printed at Dar al-Kitab al-Arabi in Cairo in 1372 AH (and also recorded as three volumes) .
