Usul al-Fiqh (أصول الفقه) is a foundational treatise on Islamic legal theory according to the Hanbali school, authored by the Damascene jurist and scholar Shams al-Din Ibn Muflih (d. 763 AH / 1362 CE) .
Purpose and Methodology
Ibn Muflih composed the work as a concise manual (mukhtasar) expounding legal theory on the school of Imam Ahmad ibn Hanbal . In his introduction, the author stated that his principal aim was the precise recording and critical verification of differing scholarly doctrines (tahrir al-madhahib), alongside the evaluation of narrations and the exclusion of unsubstantiated traditions commonly cited in jurisprudential discussions .
To maintain brevity while presenting comparative views across schools and theological factions, Ibn Muflih instituted a shorthand system of symbolic notation (rumuz) :
- The letter (waw) denotes agreement of the three juristic imams—Abu Hanifa, Malik ibn Anas, and al-Shafi'i—with the Hanbali position, while (kha) signifies their disagreement .
- Specific school alignments are designated by paired letters: (wa-ha) for the Hanafis, (wa-mim) for the Malikis, (wa-shin) for the Shafi'is, (wa-za) for the Zahiris, (wa-'ayn) for the Mu'tazilis, and (wa-ra) for the Ash'aris; dropping the letter (waw) indicates dissent by that respective group .
- Unqualified references to "al-Qadi" (al-Qāḍī) denote the early Hanbali authority al-Qadi Abu Ya'la .
Ibn Muflih organized the subject matter according to the standard thematic sequence prevailing in his era . Ibn al-Mubarrid noted that the book—which he also referenced under the title al-Nukat 'ala al-Muharrar—followed the framework of Ibn al-Hajib's Mukhtasar, while incorporating rare textual transmissions and scholarly benefits unmatched in other Hanbali works .
Influence and Reception
Usul al-Fiqh served as a core reference for subsequent Hanbali legal theorists:
- Ibn al-Lahham drew heavily upon it when writing al-Mukhtasar fi Usul al-Fiqh, mirroring its thematic order, phrasing, and headings .
- Taqi al-Din al-Jara'i highlighted Ibn al-Lahham's systematic reliance on Ibn Muflih in his commentary Sharh Mukhtasar Usul al-Fiqh .
- Ibn al-Mubarrid designated it as one of his primary source texts for his theoretical manual Ghayat al-Sul .
- Ala al-Din al-Mardawi frequently cited and utilized Ibn Muflih's treatise in Tahrir al-Manqul, al-Tahbir fi Sharh al-Tahrir, and Tashih al-Furu' .
- Ibn al-Najjar al-Futuhi similarly transmitted rulings and formulations from it in Sharh al-Kawkab al-Munir .
Modern Publication
The work was critically edited by Fahd ibn Muhammad al-Sadhan and published by Maktabat al-Obeikan in Riyadh (1420 AH / 1999 CE) .
