Talkhis al-Usul (تلخيص الأصول, "Abridgment of Legal Theory") is a concise introductory manual on the principles of Islamic jurisprudence (usul al-fiqh) written by the Pakistani scholar Hafiz Sana Allah al-Zahidi .
Purpose and Composition
Al-Zahidi completed the treatise on 7 Rajab 1410 AH (February 1990) in Jhelum, Pakistan . He composed it as an introductory handbook aimed at defining and clarifying essential usul terminology for beginning students through simplified explanations and illustrative examples . The work was envisioned as the initial stage in an educational curriculum designed to foster structured jurisprudential awareness anchored directly in the Quran and the Sunnah, while steering students away from narrow or partisan juristic biases . In his preface, the author noted his intention to follow it with a more comprehensive, advanced volume detailing differing school doctrines (madhahib), expanded legal applications (takhrij), and extensive examples .
Structure and Contents
The manual focuses on seven recognized legal sources and principles, classifying the Quran and the Sunnah as the two primary foundations (al-asliyyah), with the remaining five treated as subordinate (tabi'ah) to them .
The work is organized into an introduction and main divisions:
- Introduction (Tamhid): Defines the term usul al-fiqh both as a genitive compound and as a distinct discipline, outlines its three foundations of derivation (istimdad: speculative theology, the Arabic language, and the texts of the Quran and Sunnah), and states its subject matter and practical benefit in deriving legal rulings from evidence .
- Part One: Primary Sources of Rulings (Masadir al-Hukm al-Asliyyah): Covers the Quran and Sunnah across four chapters:
- Methods of textual deduction according to the majority of jurists (Turuq al-istinbat 'inda al-jumhur), covering explicit pronounced meaning (al-mantuq al-sarih), such as the definitive text (al-nass), the apparent (al-zahir), the interpreted (al-mu'awwal), and the ambiguous (al-mujmal), as well as implicit and non-explicit indications (dalalat al-iqtida', dalalat al-tanbih wa-al-ima', and dalalat al-isharah), followed by divergent meaning (al-mafhum) .
- Methods of textual deduction according to the Hanafi school (Turuq al-istinbat 'inda al-Hanafiyyah) .
- The legal ruling and its divisions (al-Hukm al-shar'i wa-ahkamuh) .
- Clarification of legislative texts (Bayan al-nusus al-shar'iyyah) .
- Subsequent Sections: Define and detail the subordinate legal sources and their associated conditions to provide the beginner with a clear foundational framework .
Publication
The book was published in a single volume in 1414 AH / 1994 CE by the Center for Manuscripts, Heritage, and Documents (Markaz al-Makhtutat wa-al-Turath wa-al-Watha'iq) in Kuwait, featuring a foreword by the center's general director, Muhammad ibn Ibrahim al-Shaybani .
