Takmilat al-Subki ala al-Majmu Sharh al-Muhadhdhab - Qita Jadida (Arabic: تكملة السبكي على المجموع شرح المهذب - قطعة جديدة) is a newly recovered and published portion of the Shafi'i legal commentary continuation written by Taqi al-Din al-Subki (683–756 AH / 1284–1355 CE) to complete Imam al-Nawawi's Al-Majmu Sharh al-Muhadhdhab.

Background and Context

Imam al-Nawawi passed away before completing his extensive commentary on Abu Ishaq al-Shirazi's Al-Muhadhdhab, leaving off during the Book of Sales (Kitab al-Buyu'). Taqi al-Din al-Subki undertook the task of continuing the commentary, beginning from the chapter on usury (Bab al-Riba).

In early modern printings of al-Majmu (such as the al-Muniriyyah edition), Subki's continuation broke off at the end of the chapter on returning goods due to defects (Bab al-Radd bi-l-Ayb). This led later scholars, including Muhammad Najib al-Muti'i—who subsequently wrote a continuation of the work—to believe that Subki had died upon reaching that chapter. However, the author's son, Taj al-Din al-Subki, had recorded in his Tabaqat al-Shafi'iyya al-Kubra that his father wrote five volumes of the continuation, extending from Bab al-Riba into the middle of the Book of Bankruptcy (Kitab al-Taflis).

Manuscript and Content

This publication brings to light a substantial missing portion of Subki's text based on a unique manuscript preserved in the Feyzullah Efendi Library in Istanbul (MSS 845 and 846), transcribed in Naskh script directly from the author's holograph and bearing marginal corrections and collation notes. The manuscript includes historical ownership entries by Muhammad ibn Khalil al-Shafi'i dating to 907 AH and by Ibrahim ibn Ahmad ibn al-Mulla Muhammad dating to 981 AH.

The newly recovered section encompasses:

  • First manuscript volume (MS 845, 149 folios): Covers the chapters following al-Radd bi-l-Ayb, starting from disputes between buyer and seller (Bab Ikhtilaf al-Mutabaya'ayn), forward sales (al-Salam), and loans (al-Qard).
  • Second manuscript volume (MS 846, 219 folios): Contains the complete Book of Pledges (Kitab al-Rahn).
