Takmilat al-Mutii ala al-Majmu Sharh al-Muhadhdhab (The Continuation of al-Majmu Sharh al-Muhadhdhab by al-Mutii) is a multi-volume legal work by the Egyptian scholar Muhammad Najib al-Mutii (d. 1406 AH / 1986 CE), written to complete the unfinished monumental Shafi'i jurisprudential commentary al-Majmu Sharh al-Muhadhdhab .
Background and Context
The foundational text, al-Muhadhdhab fi Fiqh al-Imam al-Shafii, was authored by Abu Ishaq al-Shirazi (d. 476 AH / 1083 CE) . Centuries later, al-Nawawi (d. 676 AH / 1277 CE) undertook an encyclopedic commentary upon it titled al-Majmu, yet passed away before completing the work, reaching up to the chapter on usury (Bab al-Riba) across nine volumes .
Following al-Nawawi, Taqi al-Din al-Subki (d. 756 AH / 1355 CE) took up the continuation of al-Majmu, but he also died before completing it . When al-Subki's continuation was first published in Cairo by al-Matba'ah al-Muniriyyah, the available manuscript ended at the conclusion of the chapter on returning defective merchandise (Bab al-Radd bi-l-Ayb) .
Scope and Composition
Under the assumption that Taqi al-Din al-Subki had ceased writing at Bab al-Radd bi-l-Ayb, Muhammad Najib al-Mutii resumed the commentary from the exact point where the Muniriyyah edition of al-Subki's text ended . Al-Mutii edited the preceding volumes of al-Majmu and composed his own continuation in seven volumes to bring the entire commentary on al-Muhadhdhab toward completion .
Later researchers pointed out that al-Subki had actually written much further into the book—reaching into the middle of the chapter on bankruptcy (Bab al-Taflees) across five volumes, as documented by his son Taj al-Din al-Subki—including chapters on markup sales (Murabahah), bid rigging (Najash), disputes between buyer and seller, forward contracts (Salam), loans (Qard), and collateral pledges (Rahn) . These additional portions of al-Subki's original work were subsequently identified in manuscript form in the Feyzullah collection in Turkey . Al-Mutii's reliance on the printed Muniriyyah text had led him to start his own continuation without having seen those unprinted portions of al-Subki's manuscript .
