Tahqiq al-Maqam fima yataallaq bi-Awqat al-Nahy an al-Salah min Ahkam (Verifying the Status of Rulings Pertaining to the Times Prohibited for Prayer) is a contemporary treatise on comparative Islamic jurisprudence by the Saudi scholar Id bin Safar al-Hujayli, an assistant professor in the College of Sharia at the Islamic University of Madinah . The book examines the legal rulings governing the times during which performing prayers is prohibited in Islamic law, as well as the types of obligatory, make-up, and voluntary prayers permitted or forbidden during those intervals .
Background and Purpose
The author composed the work as a dedicated comparative study (dirasah muwazanah) addressing scholarly divergence over the exact number of prohibited times and which prayers are lawful within them . He noted that he was unaware of any prior standalone treatise dedicated exclusively to the prohibited times of prayer . He was also prompted by contemporary contention surrounding certain practices, such as performing the greeting of the mosque (Tahiyyat al-Masjid) after the sunset (Maghrib) call to prayer before the obligatory prayer begins, where some individuals sat down without praying under the impression that it was prohibited according to certain madhhabs .
Structure and Contents
The book consists of an introduction, two main parts (bab), and a conclusion summarizing key findings :
-
Part One: Clarification of the Prohibited Times (Bayan Awqat al-Nahy):
- Chapter One: The legal status of prohibited times regarding their textual establishment and authenticity .
- Chapter Two: The number of prohibited times, divided into three sections: the five well-known prohibited intervals; whether the prohibition after Dawn (Fajr) and Afternoon ('Asr) prayers relates to the actual performance of the prayer or the entrance of the prayer time; and additional times discussed by jurists (the interval after sunset before Maghrib prayer, during the iqama, during the Friday sermon, during the sermons of Eid, eclipse, and rain-seeking prayers, before and after the Eid prayer, and after the Friday prayer in the mosque) .
-
Part Two: Prayers Permitted and Prohibited During the Forbidden Times (Bayan ma Yubah wa-ma la Yubah min al-Salawat fi Awqat al-Nahy): Contains nine chapters covering the make-up of missed obligatory and regular sunnah prayers (qada' al-fawa'it); the funeral prayer (salat al-janazah); the greeting of the mosque; the two rak'ahs for ihram, circumambulation (tawaf), and ablution (wudu); eclipse (kusuf) and rain-seeking (istisqa') prayers; prostrations of recitation (sujud al-tilawah) and gratitude (sujud al-shukr); repeating a prayer in congregation; vowed prayers (mandhurah) and the consultation prayer (istikhara); and voluntary prayers in Mecca during prohibited intervals .
The text concludes with indices indexing hadiths and narrations alphabetically, bibliography and reference sources alphabetically, and a detailed thematic index .
Method
The author adopted a comparative approach, presenting the positions across the four major Sunni schools of jurisprudence (Hanafi, Maliki, Shafi'i, and Hanbali), while occasionally noting opinions from the Companions and Successors . His method involves grouping points of agreement, citing differing views and their textual evidences, evaluating opposing arguments, and stating his preferred conclusion (tarjih) with supporting justification . Hadiths are referenced to standard collections such as Sahih al-Bukhari and Sahih Muslim, with authenticity grades provided for narrations outside the two collections .
