Tabyin al-Haqaiq Sharh Kanz al-Daqaiq wa Hashiyat al-Shalabi is a classical Hanafi legal work comprising the commentary Tabyin al-Haqaiq by Fakhr al-Din al-Zayla'i (d. 743 AH / 1343 CE) on Hafiz al-Din al-Nasafi's (d. 710 AH / 1310 CE) legal primer Kanz al-Daqaiq, accompanied by the marginal supercommentary (hashiya) of Shihab al-Din Ahmad al-Shalabi (d. 1021 AH / 1612 CE).
Content and Method
The base text, Kanz al-Daqaiq, was compiled by al-Nasafi as a condensed summary of his earlier work al-Wafi, intended to encompass prevalent legal scenarios and fatwa cases in concise phrasing. In his introduction to Tabyin al-Haqaiq, al-Zayla'i states that he structured his commentary as a work of intermediate length designed to unpack the base text's expressions, provide the legal rationale behind its rulings, and supplement it with relevant subsidiary legal branches (furu'). He titled the work Tabyin al-Haqaiq because it clarifies the subtle juristic points condensed within the primer and supplies necessary additions.
The supercommentary by Shihab al-Din Ahmad ibn Muhammad al-Shalabi provides critical annotations, glosses difficult passages in al-Zayla'i's text, and offers cross-references and textual corrections from other Hanafi legal authorities.
Reception
Tabyin al-Haqaiq became one of the primary reference commentaries on Kanz al-Daqaiq within the Hanafi school. Zayn al-Din Ibn Nujaym praised it as the best commentary composed on Kanz al-Daqaiq, though he observed that al-Zayla'i engaged extensively in comparative juristic differences (khilafiyyat) at the expense of fully delineating the direct and implied textual meanings of the base text. In subsequent Hanafi literature, such as Ibn Nujaym's al-Bahr al-Raiq, references to "the Commentator" (al-Sharih) typically denote al-Zayla'i.
Publication
The work was published in six volumes by the Amiri Press at Bulaq, Cairo, in 1313 AH (1895–1896 CE). In this standard layout, al-Zayla'i's commentary is situated at the top of each page, separated by a dividing line from al-Shalabi's supercommentary printed below it.
