Sharh Tanqih al-Fusul (Explanation of the Revision of Chapters) is a seminal work on Islamic legal theory (usul al-fiqh) by the Maliki scholar Shihab al-Din al-Qarafi (d. 684 AH / 1285 CE) . It is an autocommentary on his own concise handbook, Tanqih al-Fusul fi Ilm al-Usul (also known as Tanqih al-Fusul fi Ikhtisar al-Mahsul) .

Origin and Composition

The base text, Tanqih al-Fusul, was originally composed by al-Qarafi as the second introduction to his expansive legal encyclopedia, al-Dhakhira . Al-Qarafi designed it to ground jurists in the essential principles, terminology, and legal maxims necessary for deriving substantive legal branches (furu') from foundational roots (usul) . In compiling the primer, he primarily condensed four major works: al-Mahsul by Fakhr al-Din al-Razi, the two-volume al-Ifadah by al-Qadi Abd al-Wahhab, al-Isharāt by Abu al-Walid al-Baji, and the introductory methodological treatise in the disputation work of Ibn al-Qassar, adding original legal rules, distinctions, and syntheses .

As the base text gained widespread popularity and became heavily studied during his lifetime, al-Qarafi authored Sharh Tanqih al-Fusul to clarify its obscurities and unpack nuanced points that could only be authentically elucidated by its original author . Al-Qarafi completed the commentary in 677 AH .

Structure and Method

The commentary is structured as a blended commentary (sharh mamzuj), integrating the base text with explanatory expansions, arguments, and discussions of legal differences . Following the layout of the base text, the work is organized into twenty overarching chapters (abwab) containing 102 sub-sections (fusul) :

  • Chapter 1: Terminological definitions (al-istilahat), comprising twenty sections covering foundational terms such as definitions (al-hadd), the meaning of usul al-fiqh, truth and metaphor (al-haqiqa wa-al-majaz), homonymy (al-mushtarak), textual clarity, commands, prohibitions, concepts, and legal rulings .
  • Chapter 2: Meanings of linguistic particles needed by the jurist .
  • Chapter 3: Apparent conflict among verbal implications .
  • Chapters 4–10: Detailed linguistic and legal considerations of commands (al-awamir), prohibitions (al-nawahi), general expressions (al-umum), the minimum of plural (aqall al-jam'), exceptions (al-istithna'), conditional clauses (al-shurut), and absolute versus qualified expressions (al-mutlaq wa-al-muqayyad) .
  • Subsequent Chapters: Topics spanning the actions of the Prophet ﷺ, consensus (al-ijma'), traditions, legal analogy (al-qiyas), conflict and preference (al-ta'arud wa-al-tarjih), and legal reasoning (al-ijtihad) .

Throughout the text, al-Qarafi incorporates recurrent pedagogical headings such as qa'idah (maxim/rule), fa'idah (benefit), tanbih (caveat/alert), mas'alah (case/issue), and su'al (inquiry) . He also refers the reader to his other compositions, including al-Dhakhira, Nafa'is al-Usul, al-Istighna' fi Ahkam al-Istithna', al-Umniyyah fi Idrak al-Niyyah, and al-Ajwibah al-Fakhirah .

Reception and Commentaries

Sharh Tanqih al-Fusul is recognized as one of the primary references in Maliki jurisprudence and legal theory . Muhammad Ju'ayt (d. 1337 AH), Grand Mufti of Tunisia, noted that the work served as the principal Maliki manual taught at the Great Mosque of Tunis when early Maliki works on legal theory were scarce in the region .

Later scholars authored several supercommentaries (hawashi) directly on al-Qarafi's commentary, including:

  • Manhaj al-Tahqiq wa-al-Tawdih li-Hall Ghawamid al-Tanqih by Muhammad ibn Hammuda Ju'ayt (d. 1337 AH) .
  • Hashiyat al-Tawdih wa-al-Tashih li-Mushkilat Kitab al-Tanqih by Muhammad al-Tahir ibn Ashur (d. 1394 AH) .

The underlying base text was also independently expounded by numerous jurists, such as Ibn al-Banna al-Marrakushi (d. 721 AH), Ahmad al-Tadili al-Fasi (d. 741 AH), Yahya al-Mistasi, Ahmad ibn Hilal al-Sanhaji (known as al-Hululu), and al-Husayn al-Shushawi in his Raf' al-Niqab 'an Tanqih al-Shihab .

Publication History

The work was printed in Cairo in 1393 AH / 1973 CE, edited by Taha Abd al-Ra'uf Sa'd and published by Sharikat al-Tiba'ah al-Fanniyyah al-Muttahidah in a single volume . It has also been the subject of critical academic editions and university theses .
