Sharh Risala Latifa Jami'a fi Usul al-Fiqh al-Muhimma (A Commentary on the Concise, Comprehensive Treatise on the Essentials of Legal Theory) is a contemporary commentary on Islamic jurisprudence principles (usul al-fiqh) written by Khalid al-Mushayqih .
Origin and Composition
The work is an explanation of Risala Latifa Jami'a fi Usul al-Fiqh al-Muhimma, an introductory treatise on legal theory composed by the Hanbali scholar Abd al-Rahman al-Sa'di, who completed the original text on 25 Jumada al-Akhira 1373 AH .
Al-Mushayqih developed the commentary from pedagogical lectures delivered during multiple intensive scholarly courses taught in various regions of Saudi Arabia and Kuwait . The material was transcribed, arranged, and hadith-referenced by Khalil ibn Ali al-Marshud, after which al-Mushayqih revised the compilation and appended further legal questions and clarifications . The author finalized the preface to the text on 10 Safar 1437 AH .
Contents and Structure
The commentary follows the framework of al-Sa'di's base text, providing linguistic, theoretical, and practical expositions of foundational legal concepts . It covers several core topics of legal theory:
- The definition and nature of legal theory and the division of divine rulings into ontological (qadari), normative legal (shar'i), and eschatological (jaza'i) categories .
- The five normative legal rulings (al-ahkam al-khamsa): obligation, prohibition, recommendation, discouragement, and neutrality .
- The recognized textual and rational sources of law from which jurisprudence is derived .
- Key principles of textual interpretation, normative maxims, and fundamental rules governing legal deduction .
