Sharh Mukhtasar al-Tahawi (Explanation of al-Tahawi's Abridgment) is a commentary on Hanafi jurisprudence written by Abu Bakr al-Razi al-Jassas (d. 370 AH / 981 CE) on the foundational legal compendium of Abu Ja'far al-Tahawi (d. 321 AH / 933 CE) .

Background and Purpose

Al-Tahawi compiled his Mukhtasar to synthesize the essential branches of law and the authoritative doctrines of Abu Hanifa and his companions, drawing primarily upon the standard transmissions (zahir al-riwayah) recorded by Muhammad ibn al-Hasan al-Shaybani . Al-Jassas composed his commentary at the request of an esteemed colleague, seeking to elucidate the textual reasons, underlying rationales, and principles of legal derivation (qiyas and ijtihad) underpinning the rulings in al-Tahawi's text . His intended objective was to combine legal theory (usul) and substantive law (furu'), thereby facilitating comprehension of the foundational works of the Hanafi school .

Methodology and Structure

Al-Jassas sought conciseness throughout the work, though he expanded on complex issues involving extensive legal disagreement . In supporting the Hanafi positions, he drew upon textual and rational proofs from the Qur'an, Sunnah, scholarly consensus (ijma'), and systematic analogical deduction (qiyas / nazar), explaining the exact nature of textual indication (wajh al-dalalah) for each ruling .

The work incorporates comparative jurisprudence (fiqh muqaran); al-Jassas presents the arguments of opposing juristic schools, generally framing their positions as hypothetical objections using phrases such as "If it is said" (fa-in qila) without frequently naming the opponents explicitly, before refuting them with "It is said to him" (qila lahu) . He also offers critical appraisals of al-Tahawi's formulations, introduces new subsidiary questions (tafri'at), and organizes the text into distinct headings labeled "Issue" (Mas'alah) .

Significance and Publication

Sharh Mukhtasar al-Tahawi is regarded as one of the earliest and most authoritative commentaries on al-Tahawi's manual in both textual transmission and analytical jurisprudence .

After remaining in manuscript form for over a thousand years, the complete text was edited across four doctoral dissertations submitted to the College of Sharia at Umm al-Qura University by 'Ismat Allah 'Inayat Allah Muhammad, Sa'id Muhammad Yahya Bakdash, Muhammad 'Ubayd Allah Khan, and Zaynab Muhammad Hasan Fallatah . It was published in eight volumes in 1431 AH (2010 CE) jointly by Dar al-Basha'ir al-Islamiyyah in Beirut and Dar al-Siraj in Medina, with an introduction by Sa'id Bakdash .
