Sharh Dalil al-Talib is a legal commentary on the Hanbali primer Dalil al-Talib li-Nayl al-Matalib by Abd Allah al-Maqdisi (d. after 1091 AH / 1680 CE) .
Scope and Structure
The work is an intermediate-length commentary on Dalil al-Talib, a standard manual of Hanbali jurisprudence authored by Mar'i ibn Yusuf al-Karmi (d. 1033 AH / 1624 CE), who was the paternal uncle of the commentator's father . The commentary was left incomplete, ending in the chapter on fighting rebels (bab qital al-bughah) within the book of penal laws (kitab al-hudud) .
Method and Sources
Abd Allah al-Maqdisi adopts a concise explanatory style, blending his commentary directly with the phrasing of the base text so that both read as a single coherent prose work . His method includes:
- Providing scriptural evidence (dalil) and legal rationale (ta'lil) for the majority of legal issues while avoiding extensive coverage of intra-school disputes .
- Supplying complementary branch rulings (furu'), definitions, caveats, and structural subdivisions to elucidate the base manual .
- Pointing out differences between standard late reference works, notably Musa al-Hajjawi's al-Iqna' and Ibn al-Najjar al-Futuhi's al-Muntaha .
- Drawing heavily upon foundational later Hanbali authorities, including Ali ibn Sulayman al-Mardawi's al-Insaf, Mar'i al-Karmi's Ghayat al-Muntaha, and the legal treatises and glosses of Mansur ibn Yunus al-Bahuti .
- Frequently citing the legal preferences (ikhtiyarat) of Ibn Taymiyyah .
Reception and Publication
The commentary was referenced and utilized by subsequent Hanbali jurists; Ahmad ibn Muhammad ibn 'Iwad cited it in Fath Wahhab al-Ma'arib, as did Ibn Humayd in his supercommentary on Sharh al-Muntaha . In modern scholarship, Bakr Abu Zayd noted Ibn Humayd's citations of the work in al-Madkhal al-Mufassal while observing that the commentator's specific identity had remained unclarified to him .
The work was edited by Ahmad ibn Abd al-Aziz al-Jammaz and published in three volumes by Dar Atlas al-Khadra' in Riyadh (1436 AH / 2015 CE) .
