Raf al-Niqab an Tanqih al-Shihab (Lifting the Veil from the Shihab's Tanqih) is an extensive commentary on legal theory (usul al-fiqh) by the Moroccan Maliki scholar al-Husayn al-Shushawi (d. 899 AH / 1493–1494 CE), written to explicate and expand upon Shihab al-Din al-Qarafi's (d. 684 AH / 1285 CE) foundational text Tanqih al-Fusul.
Background and Scope
The base text, Tanqih al-Fusul, is a concise treatise on legal theory structured into twenty chapters covering topics ranging from technical terminology, linguistic indications, commands and prohibitions, to consensus, legal analogy (qiyas), and legal reasoning (ijtihad). Due to the condensed nature of al-Qarafi's phrasing and the density of opinions contained in the text, al-Shushawi composed his commentary to uncover its subtleties and make its arguments accessible, naming it Raf al-Niqab metaphorically as an act of removing the veil from al-Qarafi's work. In biographical and bibliographical literature, the work is alternatively referred to simply as Sharh al-Tanqih or Sharh Tanqih al-Qarafi.
Methodology and Structure
Al-Shushawi's work functions as an encyclopedic exposition that explicates the base text verbatim, clause by clause. His approach is characterized by several distinctive methodological features:
- Introductory contextualization: He precedes chapters, sections, and individual legal problems with introductory overviews (tamhid) to establish the framework of discussion.
- Linguistic and terminological analysis: He provides detailed linguistic definitions, clarifying obscure or rare terminology (sharh al-gharib) and occasionally digressing into broader grammatical and philological considerations.
- Delineation of disputes: He meticulously pinpoints the exact point of contention (tahrir mahall al-niza), explains the underlying cause of scholarly disagreement (sabab al-khilaf), and traces the practical legal consequences resulting from it (thamrat al-khilaf).
- Application and substantiation: He places heavy emphasis on jurisprudence in practice, illustrating abstract theoretical principles with substantive legal examples and case applications (tatbiqat fiqhiyyah).
- Comparative jurisprudence: While focusing on the positions of the Maliki school, he surveys opinions across other Sunni legal traditions, detailing their respective arguments and debates.
Sources
Raf al-Niqab synthesizes earlier commentaries and major works of Islamic jurisprudence. Al-Shushawi drew extensively upon al-Qarafi's own self-commentary (Sharh Tanqih al-Fusul) and the commentary by Yahya ibn Abi Zakariyya al-Mastasi, alongside other unnamed commentaries on the Tanqih. He also incorporates citations from classical authorities across various schools, including Abu Bakr al-Baqillani, al-Qadi Abd al-Wahhab, Abu al-Walid al-Baji, al-Mazari, Sayf al-Din al-Amidi, and Ibn al-Hajib.
Reception and Publication
The commentary has been noted by scholars of legal theory as one of the most comprehensive and valuable print commentaries on al-Qarafi's Tanqih due to its thoroughness, its incorporation of material from earlier lost treatises, and its systematic arrangement. The complete text was edited by Ahmad ibn Muhammad al-Sarrah as an academic dissertation and published in six volumes by Maktabat al-Rushd in Riyadh (1425 AH / 2004 CE).
