Miftah al-Wusul ila Bina al-Furu ala al-Usul (The Key to Attainment in Grounding Branches on Principles) is a treatise on legal theory (usul al-fiqh) by the Maliki jurist al-Sharif al-Tilimsani (710–771 AH / 1310–1370 CE), classified within the genre of takrij al-furu ala al-usul (deriving substantive legal rulings from theoretical principles) .
Title and Composition
The book is recorded under several slight title variations in historical and bibliographical sources. Isma'il Pasha al-Baghdadi listed it in Idah al-maknun as Miftah al-wusul ila bina al-furu ala al-usul, noting its presence in the collection of the Zaytuna . In Nayl al-ibtihaj, it appears as Miftah al-usul fi bina al-furu ala al-usul, while another print carries the title Miftah al-wusul fi 'ilm al-usul, whose prologue gives the phrasing Miftah al-usul fi ibtina al-furu ala al-usul . In the prologue, the author dedicates praise to the Marinid sultan Abu 'Inan Faris .
Method and Structure
The work is considered one of the foremost texts in the methodology of linking positive jurisprudence (furu) directly to theoretical maxims and principles (usul) . Whereas other prominent works in this genre limited their practical legal applications to one or two schools—such as Shihab al-Din al-Zanjani's Takrij al-furu ala al-usul (Hanafi and Shafi'i) or al-Isnawi's al-Tamhid fi takrij al-furu ala al-usul (Shafi'i)—al-Sharif al-Tilimsani compares and applies principles across three legal schools: the Maliki, Hanafi, and Shafi'i schools .
The author establishes theoretical points in a concise, clear style and couples each rule with the differing branch rulings derived from it . The structure reflects an organizational model utilized by Maghrebi scholars, drawing upon predecessors such as Abu al-Walid al-Baji . Notably, the book omits the standard usuli chapters on legal reasoning (ijtihad), following authority (taqlid), and the conflict and reconciliation of evidence (al-ta'arud wa-al-tarjih) .
Reception and Editions
Miftah al-wusul achieved widespread circulation among scholars and jurists across North and West Africa . The Algerian reformist scholar Abd al-Hamid Ibn Badis utilized the book as a primary text for teaching usul al-fiqh to his students and authored an unpublished concise gloss (sharh mukhtasar) on it .
The book has been printed in several editions:
- An edition published in Cairo (1382 AH / 1962 CE) by Dar al-Kitab al-Arabi, supervised by the Grand Qadi of Northern Nigeria, Abu Bakr Mahmud Gumi, and financed by Sir Ahmadu Bello, Premier of Northern Nigeria .
- An edition edited by Abd al-Wahhab Abd al-Latif, published by Maktabat al-Khanji in Cairo (1962 CE) and later reissued by Dar al-Kutub al-Ilmiyya in Beirut (1403 AH / 1983 CE) .
- A critical edition by Muhammad Ali Ferkous, published by al-Maktaba al-Makkiyya and Muassasat al-Rayyan .
