Mas'ala fi Rajul Hanafi Tazawwaj Saghira bi-Wilayat Ummiha (A Juristic Question Regarding a Hanafi Man Marrying a Minor Female Under Her Mother's Guardianship) is a legal epistle by the Yemeni scholar Abd al-Rahman al-Muallimi al-Yamani (d. 1386 AH / 1966 CE) addressing the validity, annulment, and cross-school rulings concerning the marriage of a minor contracted by her mother .
Background and Manuscript
The treatise was composed as a formal response to an inquiry sent by Sayyid Muhammad Makhdum al-Husayni, the mufti of al-Madrasa al-Nizamiyya in Hyderabad, who sought a legal verdict on a Hanafi man contracting marriage with a minor girl under the guardianship (wilayah) of her mother .
The extant text is preserved in Maktabat al-Haram al-Makki among its uncataloged drafts . The manuscript spans two long-format pages, suffered water damage that obscured some words, and is truncated at the end . It is published as the thirty-sixth treatise in the collection Athar al-Mu'allimi .
Contents and Juristic Analysis
Al-Mu'allimi structures his response around the comparative jurisprudence of the Shafi'i and Hanafi legal schools :
-
The Shafi'i School's Position: He outlines that under Shafi'i jurisprudence, marriage requires a valid guardian; a mother cannot act as guardian for her daughter's marriage contract, and a free minor female may only be married off by her father or paternal grandfather in the father's absence . He cites al-Shafi'i's section Ikhtilaf al-Iraqiyyin from Kitab al-Umm, establishing that if any other relative marries off a minor, the marriage is nullified (mafsukh), no inheritance occurs between the parties even if they reach maturity, pronounced divorces do not take effect, and if consummated, the bride receives her dower and the two are separated .
-
Annulment via Legal Conformity (Taqlid): Al-Mu'allimi discusses whether the marriage may subsequently be annulled by following the Shafi'i position :
- If a judge has already ruled the marriage valid, it cannot be overturned .
- If no judicial verdict exists and only the mother seeks annulment, her request has no legal bearing .
- If both the husband and the girl mutually agree to adopt the Shafi'i school to annul the contract, later jurists deem this permissible because it does not involve illegitimate eclectic combination (talfiq), drawing on references from Tuhfat al-Muhtaj by Ibn Hajar al-Haytami, the Fatawa of Taqi al-Din al-Subki, and Nihayat al-Muhtaj by al-Ramli .
- If the wife alone seeks to follow the Shafi'i view to annul the contract without her husband's consent, she is not permitted to do so .
-
Cross-Madhhab Variations: Al-Mu'allimi notes that these distinctions apply if the husband or mother is Shafi'i while the daughter is Hanafi by paternal lineage, and the parties agreed at the contract to follow Abu Hanifa . Likewise, if the daughter is Shafi'i by paternal lineage but a qualified jurist issues a fatwa permitting her marriage under Abu Hanifa's school for her verified benefit, she is treated under Hanafi rules in that matter . He concludes by noting that where conformity with Abu Hanifa's doctrine is permitted, all Hanafi conditions must be observed, including marital suitability (kafa'ah), without which the marriage remains invalid .
