Masa'il Harb al-Kirmani: Kitab al-Tahara (The Book of Purification from the Legal Questions of Harb al-Kirmani) is the opening legal section of the extensive jurisprudential compilation authored by the early traditionalist Abu Muhammad Harb ibn Isma'il al-Hanzali al-Kirmani (d. 280 AH / 893–894 CE) . It records the legal determinations, transmissions, and rulings of Ahmad ibn Hanbal and Ishaq ibn Rahwayh concerning ritual purity .
Scope and Content
The text encompasses questions of ritual purification, addressing topics such as water categories—including the threshold of water that is not rendered impure by external matter (Bab al-ma' alladhi la yunanajjisuhu shay')—dry ablution (tayammum), and the cleansing of impurities such as blood, urine, and bodily wastes . Alongside the direct responsa of Ahmad and Ishaq, Harb includes rulings and narrations from the Prophet ﷺ, the Companions, and Successors such as Ibrahim al-Nakha'i, al-Sha'bi, and Sufyan al-Thawri . It also records textual and isnad discussions, such as Ahmad's and Ishaq's authentication of traditions concerning the performance of tayammum with a single strike for the face and hands .
Method and Structure
Harb arranged his collection topically under standard chapters of jurisprudence, modeled after the structure of early compilations such as the Muwatta . His presentation primarily opens inquiries with formulas such as "I asked Ahmad," "I said to Ahmad," or "I asked Ishaq," frequently repeating the same problem to both authorities to record their respective viewpoints or noting where one agreed with the other . In addition to transmitting legal opinions, the work cites chains of transmission (isnad) and identifies hidden textual or transmission defects ('ilal) in traditions used for legal deductions .
Transmission and Modern Editions
Al-Dhahabi characterized Harb's Masa'il as one of the most valuable collections within the Hanbali school . The early chapters of the work, including Kitab al-Tahara, were preserved in partial manuscripts and later prepared through academic research:
- A critical study and edition of the section spanning from Bab al-ma' alladhi la yunanajjisuhu shay' to the conclusion of Kitab al-Tahara was completed as a doctoral dissertation by 'Amir ibn Muhammad Fida Bahjat at the Islamic University of Madinah in 1432 AH .
- Sections covering purification and prayer were edited by Dr. al-Walid Al Faryan and published by Dar Ibn al-Athir in 1431 AH / 2010 CE .
- An edition of the combined purification and prayer sections was prepared by Muhammad ibn 'Abd Allah al-Sariyi' and published in one volume by Mu'assasat al-Rayyan in Beirut in 1434 AH / 2013 CE .
