Masa'il Harb al-Kirmani min Kitab al-Nikah ila Nihayat al-Kitab (The Legal and Theological Questions of Harb al-Kirmani from the Book of Marriage to the End of the Book) is the extant latter portion of the major early collection of juridical responsa and hadith transmissions compiled by the Hanbali jurist and traditionist Harb ibn Isma'il al-Kirmani (d. 280 AH / 893 CE) . The work documents religious queries, legal verdicts (masa'il), and theological statements transmitted primarily from Ahmad ibn Hanbal and Ishaq ibn Rahwayh .
Background and Composition
Harb al-Kirmani was a prominent disciple of Ahmad ibn Hanbal and Ishaq ibn Rahwayh . Before meeting them, he had reportedly memorized about 4,000 legal questions concerning their views . According to al-Khalil ibn Abd Allah al-Qazwini, Ahmad dictated to Harb a collection of history and masa'il comprising 130 fascicles (juz'), making it one of the largest compilations of transmissions from Ahmad . Abu Bakr al-Khallal traveled to Kirman upon the urging of Abu Bakr al-Marrudhi to collect Harb's transmission of Ahmad's legal rulings, noting the exceptional quality and unique material found in Harb's questions .
Method and Structure
Ibn Taymiyyah observed that Harb arranged his extensive work along the topical structure of works such as the Muwatta' . In compiling the text, Harb typically opens questions by stating "I asked Ahmad" (sa'altu Ahmad), "I said to Ahmad" (qultu li-Ahmad), or "Ahmad narrated to us" (haddathana Ahmad), using equivalent formulas for Ishaq ibn Rahwayh . In various passages, he addresses the same inquiry to both imams, presents a prophetic hadith with his own chain of transmission to deduce legal rulings, or records supportive opinions from early authorities such as Sa'id ibn Mansur and Abd Allah ibn al-Zubayr al-Humaydi .
This specific preserved volume opens with Kitab al-Nikah (the Book of Marriage) and covers consecutive legal topics including:
- Kitab al-Talaq (Divorce)
- Kitab al-Khul' (Mutual Divorce / Separation)
- Kitab al-Ila' (Vows of Continence)
- Kitab al-Zihar wa-al-Li'an (Injurious Assimilation and Imprecation)
- Kitab al-Adwiyah (Medicines)
The compilation concludes with the general section titled Kitab al-Jami', which contains a creedal statement outlining the doctrinal consensus of the traditionists (ijma' al-salaf) concerning issues of faith, divine attributes, divine decree, and the imamate .
Reception and Modern Editions
Al-Dhahabi praised Harb's Masa'il as one of the most precious works of the Hanbalis, noting that the original comprised two substantial volumes . Because significant portions of the complete corpus remain unrecovered or in manuscript form, the surviving portions have been studied separately in contemporary scholarship .
This portion, from the chapter of marriage to the end of the text, was critically edited as a doctoral dissertation at Umm al-Qura University by Fayiz ibn Ahmad ibn Hamid Habis (1422 AH) . It was also published under the editorial care of Nasir ibn Sa'ud al-Salamah .
