Majmuat al-Fawaid al-Bahiyya ala Manzumat al-Qawaid al-Fiqhiyya (A Collection of Splendid Benefits on the Didactic Poem of Legal Maxims) is a commentary on legal maxims (al-qawaid al-fiqhiyya) by Salih ibn Muhammad al-Asmari . The work explains Manzumat al-Qawaid al-Fiqhiyya, a 47-verse didactic poem composed by Abd al-Rahman ibn Nasir al-Sadi .

Origin and Composition

The commentary originated as a series of lessons delivered by al-Asmari at the Abu Bakr al-Siddiq Mosque in the city of Ta'if in 1418 AH (1997–1998 CE) . The lectures commenced in that year and concluded on the night of the 13th of Ramadan 1418 AH .

The text of the commentary was transcribed and prepared for publication by Mut'ib ibn Mas'ud al-Ju'ayd, a student at Umm al-Qura University, who added an introduction, supplied thematic headings for each maxim based on standard juristic phrasing, and compiled an analytical index of topics . Al-Asmari reviewed the resulting work and granted permission for its publication and printing .

Structure and Scope

The book is structured into an authorial introduction followed by the verse-by-verse commentary . The introduction consists of two main chapters:

  • Chapter One: An overview of the science of legal maxims (ilm al-qawaid al-fiqhiyya), divided into four subsections covering the definition of a legal maxim (al-qa'ida al-fiqhiyya), the distinction between a legal maxim and a specific legal rule or precept (al-dabit al-fiqhi), the classifications of legal maxims, and the history of their codification .
  • Chapter Two: A concise presentation of the poem and its author, comprising a brief biographical sketch of al-Sadi and an overview of the poem itself .

The commented text comprises al-Sadi's 47 verses, which summarize thirty-three maxims in broad terms and encompass approximately fifty or more when analyzed in detail with their subsidiary legal branches .

Method and Features

The commentary focuses on clarifying vocabulary, resolving complex phrasings, and unpacking concise expressions without excessive elongation . For each maxim, the author traces its textual sources and underlying principles, provides illustrative juristic examples to aid comprehension, documents references from classical works of jurisprudence and legal theory, and highlights juristic classifications and subsidiary points of benefit .
