Khulasat al-Jawahir al-Zakiyya fi Fiqh al-Malikiyya (The Essence of the Pure Jewels in Maliki Jurisprudence), also known by its original title al-Jawahir al-Zakiyya fi Hall Alfaz al-ʿAshmawiyya (The Pure Jewels in Unraveling the Phrasings of al-ʿAshmawiyya), is a classical commentary on Islamic jurisprudence according to the Maliki school, authored by the Egyptian Maliki jurist Ahmad bin Turki al-Manshalili (d. 979 AH / 1571 CE) .
Scope and Content
The work serves as an explanatory commentary on al-Muqaddima al-ʿAshmawiyya (also known as Matn al-ʿAshmawiyya), an introductory legal manual on acts of worship written by the Egyptian scholar ʿAbd al-Bari al-ʿAshmawi . In the treatise, Ibn Turki explicates the concise expressions of the base text, elucidating foundational rules of ritual purity, prayer, and related branches of legal practice (furuʿ) according to the established positions of the Maliki madhhab .
Scholarly Reception and Glosses
The commentary gained wide circulation in Maliki pedagogical circles and prompted numerous prominent scholars to author glosses (hawashi) and supercommentaries upon it :
- Hashiyat al-Safti by the Egyptian Maliki jurist Yusuf bin Saʿid al-Safti (d. 1193 AH or later), which became the most commonly printed companion gloss to the work .
- A gloss by the Upper Egyptian scholar ʿAli al-Saʿidi al-ʿAdawi (d. 1189 AH) .
- Al-Hashiya al-Mardiyya by Muhammad bin Ahmad al-Kharbatawi (d. after 1217 AH) .
- A gloss by Muhammad al-Amir al-Kabir (d. 1232 AH) .
- Al-Durar al-Bahiyya by the grand mufti of the Malikis in Egypt, Muhammad ʿIllaysh .
Publication History
The commentary was published early in Cairo in multiple lithographic and typography editions, including printings in 1279 AH (1862 CE), 1280 AH, 1281 AH (1864 CE) by the Castelli press, 1302 AH (1885 CE), 1316 AH by al-Matbaʿa al-Bahiyya, and 1329 AH (1911 CE) by al-Jamaliyya press . It was later printed under the title Khulasat al-Jawahir al-Zakiyya fi Fiqh al-Malikiyya alongside al-Safti's marginal gloss, edited and reviewed by Hasan Muhammad al-Hifnawi, and published by the Cultural Foundation in Abu Dhabi in 2002 .
