Kashf al-Khafa an Hukm Bay al-Wafa (Arabic: كشف الخفاء عن حكم بيع الوفاء, lit. 'Unveiling the Obscurity Regarding the Ruling on Redemption Sales') is a short legal treatise by the Yemeni scholar Abd al-Rahman al-Muallimi al-Yamani (1313–1386 AH / 1895–1966 CE) examining the jurisprudential status of the sale known as bay al-wafa or bay al-uhdah .

Background and Context

Al-Mu'allimi composed the work after being asked by peers about the legal ruling on bay al-wafa—also known as bay al-uhdah—a transaction widespread in Hadramawt and various other regions . To investigate the issue, he reviewed available works written by Hadrami scholars, including Bughyat al-mustarshidin (citing the fatwas of Abd Allah ibn al-Husayn Bafaqih), Tarshih al-mustafidin, and Ahmad ibn Abi Bakr Ba Qushayr's al-Qala'id .

From these references, al-Mu'allimi extracted seven legal justifications and arguments cited in favor of the practice:

  1. Under the Shafi'i school, if the contract is preceded by mutual understanding (muwata'ah) and executed conclusively (battan), the sale is binding and effective, while the buyer's pre-contract agreement is a promise that is recommended (yustahabb)—though not legally obligatory (la yajib)—to fulfill .
  2. The legal basis for obligating the buyer to fulfill the promise rests on following the school of Malik ibn Anas .
  3. The possibility of relying on the school of Ahmad ibn Hanbal regarding the permissibility of sales with conditions .
  4. The possibility of relying on Ahmad's school regarding the permissibility of perpetual options (ta'bid al-khiyar) .
  5. The possibility of relying on the school of Abu Hanifa .
  6. Justifying departure from one's school on the grounds of necessity (darurah) .
  7. The reliance of later jurists merely upon the settled practice of earlier scholars .

Method and Scope

Al-Mu'allimi intended to discuss and evaluate these seven points sequentially . He affirmed the first point, noting that avoiding prior mutual understanding is recommended to steer clear of the opinion of scholars who treat pre-agreed terms as contractual stipulations that invalidate the sale .

Turning to the second point, he examined Maliki texts, citing the Muwatta (including reports concerning Abd Allah ibn Mas'ud, Umar ibn al-Khattab, and Abd Allah ibn Umar), Abu al-Walid al-Baji's commentary al-Muntaqa, and Muhammad ibn Ahmad al-Dasuqi's gloss on al-Sharh al-kabir . Through these sources, he demonstrated that the transaction (known among Malikis as bay al-thunya or bay al-ma'ad) is invalid (fasid) in their madhhab if the condition is agreed upon at or before the contract, and that fulfilling a post-contract voluntary promise is only recommended rather than legally binding . The text halts abruptly during this discussion and was left incomplete .

Manuscript and Publication

The unique manuscript of the treatise is found at the end of notebook no. 4244, which also contains al-Mu'allimi's treatise Jawab al-istifta an haqiqat al-riba . It occupies four small-format pages, which the author wrote upside down in relation to the preceding text to distinguish the two works . The text was edited and published as the twenty-ninth treatise within the collection of al-Mu'allimi's jurisprudential treatises (Majmu Rasa'il al-Fiqh), included in the multi-volume Athar al-Mu'allimi .
