Juz min Sharh Tanqih al-Fusul fi Ilm al-Usul is an academic study and critical edition of the second portion of the legal theory treatise Sharh Tanqih al-Fusul fi Ilm al-Usul by the Maliki jurist al-Qarafi (d. 684 AH / 1285 CE) . Prepared by Nasir ibn Ali ibn Nasir al-Ghamdi under the supervision of Hamza ibn Husayn al-Fa'r, it was submitted as a master's thesis in Islamic Studies in 1421 AH / 2000 CE .

Scope and Structure

The work is organized into two primary divisions: an analytical study (al-qism al-dirasi) and the edited text (al-qism al-tahqiqi) . The edited text covers the treatise from the opening of the thirteenth chapter—concerning the legal implications of the actions of the Prophet ﷺ—through to the conclusion of the book .

The introductory study comprises an introduction and three chapters:

  • Introduction and historical context: Outlines the importance of legal theory (usul al-fiqh), the motives for undertaking the edition, prior editorial efforts, and a concise survey of al-Qarafi's historical era, including political, social, and intellectual conditions .
  • Biography of al-Qarafi: Covers his lineage, origin, birth, upbringing, theological creed, legal madhhab, teachers, students, scholarly stature, writings, and death .
  • Study of the text: Analyzes the base text (Tanqih al-Fusul), the commentary's title variants, the date and causes of its composition, its arrangement and subject matter, its cited sources, al-Qarafi's methodology and style, its scholarly merit, critical observations, and a comparison between al-Qarafi's commentary and other commentaries on the text .

Editorial Method

In establishing the text, the editor examined multiple manuscript witnesses, addressing variations in the phrasing of the title between copies such as Sharh Tanqih al-Fusul fi Ilm al-Usul and Sharh Tanqih al-Fusul fi Ikhtisar al-Mahsul . The critical apparatus provides annotations identifying unfamiliar geographical locations, cited titles, and mentioned sects and theological schools, supplemented by detailed analytical indexes .
