Imarat al-Qubur fi al-Islam: al-Musawwada (The Construction over Graves in Islam: The Draft) is a jurisprudential and creedal treatise by the Yemeni scholar Abd al-Rahman al-Muallimi al-Yamani (1313–1386 AH / 1896–1966 CE) examining the legal rulings and doctrinal implications of building structures over graves .

Background and Purpose

In the treatise's opening, al-Muallimi explains that he wrote the work after examining several contemporary writings regarding the construction of edifices over graves and observing the disputes surrounding the subject . Among the contemporary polemics he encountered and addressed was the Shia scholar Hasan al-Sadr's (d. 1354 AH) al-Radd 'ala al-Wahhabiyya (Refutation of the Wahhabis) . Aiming to assess the question objectively through direct recourse to Islamic scripture, al-Muallimi structured his study around the principles of independent legal reasoning (ijtihad), systematically analyzing textual proofs in terms of authenticity and textual implication .

Characteristics of the Draft Version

Al-Muallimi drafted his research multiple times, resulting in distinct manuscript versions that contain differing material . The draft (al-Musawwada) differs from the fair copy (al-Mubayyada) primarily by including various foundational rules and methodological principles omitted in the final redaction, where the author appears to have abridged the discussion or altered his presentation .

Publication

The work was published from manuscript by Ali ibn Muhammad al-Imran within the collected works project Athar al-Muallimi . The editors included both the fair copy (al-Mubayyada) and the draft (al-Musawwada) together in the fifth volume of the series, alongside al-Muallimi's treatise Yusr al-Aqida al-Islamiyya (The Simplicity of Islamic Creed) . Prior to this combined release, the text had appeared under separate editions: one under the title al-Bina ala al-Qubur, edited by Hakim al-Mutayri based on an early draft manuscript, and another titled Imarat al-Qubur, edited by Majid al-Zayyadi based on the later version .
