Ibtal al-Hiyal (The Invalidation of Legal Stratagems) is a legal treatise by the Hanbali scholar Ibn Batta (d. 387 AH / 997 CE) that refutes the use of legal stratagems (hiyal) designed to circumvent religious obligations and rulings .

Background and Purpose

The work originated as a response to a query concerning a man who had sworn an oath of irrevocable triple divorce to wrongfully kill a Muslim during a dispute between them . Seeking a way out of his predicament without fulfilling the sinful oath, a jurist advised him to instruct his wife to seek khulʿ (divorce initiated by the wife in exchange for compensation) so that the marital bond would be severed and the conditional oath negated; he could then propose to her through her guardian and marry her anew under a fresh contract . Ibn Batta was asked whether this fatwa had any valid basis in the Quran, the Sunnah, or the teachings of early scholars, prompting him to compose this refutation .

Structure and Contents

The treatise comprises several core topics:

  • The Qualifications of a Jurist: An extensive introductory discussion outlining the characteristics of the jurist whose legal opinions may be followed (taqlīd) and who may be consulted in complex matters, supported by Quranic verses and narrations from the early generations (salaf) .
  • Refutation of the Specific Fatwa: A direct counter-argument dismantling the legal ruling regarding the contrived dissolution of marriage to evade an oath .
  • Invalidation of Legal Stratagems: A broader legal defense demonstrating the invalidity of hiyal using evidence from the Quran, the Sunnah, and the reports of the salaf, affirming the doctrine of Imam Ahmad ibn Hanbal that legal stratagems are unacceptable in Islamic law .
  • Caution Against Reckless Rulings: A closing warning against haste and audacity in issuing fatwas without proper grounding .

Significance

Ibtal al-Hiyal is considered the earliest known dedicated treatise authored within the Hanbali school on the invalidation of legal stratagems . It served as a forerunner to later works on the same subject by subsequent Hanbali scholars, including Abu Ya'la al-Farra' (d. 458 AH), Najm al-Din al-Tufi (d. 716 AH), and Ibn Taymiyyah (d. 728 AH) .
