Fiqh al-Nawazil fi al-Ibadat

Fiqh al-Nawazil fi al-Ibadat (Jurisprudence of Contemporary Issues in Acts of Worship) is a contemporary legal work by Khalid ibn Ali al-Mushayqih that examines modern unprecedented matters (nawazil) pertaining to Islamic ritual obligations .

Origin and Purpose

The book originated from a series of lectures delivered during an intensive scholarly program at the al-Rajhi Grand Mosque in Buraidah in 1426 AH . The author defines nawazil linguistically as descending occurrences and terminologically as newly arisen circumstances that require a legal ruling in Islamic jurisprudence . In the introduction, he highlights several key objectives and benefits of investigating modern cases, including demonstrating the comprehensive applicability of Islamic law across all eras, fulfilling the communal obligation (fard kifayah) of clarifying newly emerging issues to Muslims, and cultivating juristic faculty (malakah fiqhiyyah) in the researcher .

Method and Structure

Al-Mushayqih structures his analysis by presenting an overview of each contemporary scenario and then deriving its legal ruling through legal analogical deduction (takhrij) grounded in the principles and statements of earlier classical jurists .

The work covers issues across several core chapters of acts of worship, specifically:

  • Ritual Purity (Taharah): Examines rulings on water altered by rust from pipes and containers, water mixed with modern soaps and chemical detergents, the purity of human corpses, organ transplantation, and cleaning agents formulated with questionable ingredients .
  • Prayer (Salah): Addresses astronomical calculations versus visual horizon signs for prayer times, praying in modern attire such as trousers, carrying items containing pictures, performing the call to prayer (adhan) via recordings or microphones, using modern navigation tools to determine the Qiblah, praying inside airplanes and ships, using physical partitions in women's prayer halls, following an imam over audio systems or broadcast media, placing electric heaters in front of worshippers, combining prayers in residence for urgent needs, and translating Friday sermons after the prayer for non-Arabic speakers .
  • Funerals (Jana'iz): Discusses issues related to the deceased and modern burial practices .

Publication History

The work was prepared and edited by Abd al-Aziz ibn Hawwas al-Shammari and published in a first edition in 1433 AH / 2012 CE jointly by Jam'iyyat Ihya' al-Turath al-Islami and Maktabat al-Rushd . A second edition was subsequently published by Maktabat al-Rushd in Riyadh in 1434 AH .
