Fatawa Ibn al-Salah (The Legal Rulings of Ibn al-Salah) is a compilation of religious edicts and legal opinions issued by the Shafi'i jurist and hadith master Taqi al-Din Ibn al-Salah (d. 643 AH / 1245 CE) .
Compilation and Structure
The fatwas were assembled and organized by Ibn al-Salah's student, the repetitive tutor (mu'id) at al-Madrasa al-Rawahiyya in Damascus, Kamal al-Din Ishaq ibn Ahmad ibn 'Uthman al-Ma'arri . He arranged the collection into four main thematic sections (aqsam) :
- Exegesis of the Quran: Explanations of specific Quranic verses, interpretive rules, and grammatical aspects of scripture .
- Hadith and Spiritual Exhortation: Commentary on prophetic traditions and heart-softening narrations (raqa'iq), including reconciliations of seemingly conflicting reports .
- Theology and Creedal Principles: Matters of doctrine ('aqa'id) and fundamental tenets (usul) .
- Jurisprudence (Fiqh): Practical legal inquiries arranged according to standard Shafi'i legal chapters .
In various manuscript traditions, the collection is frequently titled in conjunction with Ibn al-Salah's treatise on legal methodology and muftiship, appearing under names such as Fatawa Ibn al-Salah wa-shurut al-mufti wa-awsafuh wa-ahkamuh, Fatawa Ibn al-Salah 'ala madhhab al-Shafi'i, and Jawahir al-fatawa wa-adab al-mufti wa-l-mustafti .
Notable Rulings and Debates
The collection preserves several prominent rulings that drew scholarly attention and debate:
- Logic and Philosophy: Ibn al-Salah issued an uncompromising ruling prohibiting the study and teaching of philosophy and Aristotelian logic (mantiq), describing philosophy as the foundation of folly and deviation . He declared that Islamic jurisprudence had no need for logical terminology and called upon the authorities to exclude teachers of these disciplines from academic institutions .
- The Prayer of Ragha'ib (Salat al-Ragha'ib): Ibn al-Salah acknowledged that the specific hadith enjoining this prayer in the month of Rajab was a late fabrication, but he ruled that performing it was not prohibited because voluntary prayer is broadly encouraged under general scriptural commands . This position led to a well-known written debate (musajalah) with the Damascene jurist al-'Izz ibn 'Abd al-Salam, who maintained that the prayer was an impermissible innovation due to its specific communal form and fabricated basis .
- Hadith Harmonization: The work contains detailed harmonizations of difficult texts, such as reconciling the differences between the hadiths of Abdullah ibn Mas'ud and Hudhayfa ibn Asid regarding embryonic development stages and the dispatching of the angel .
Manuscripts and Publication
Manuscript copies of the fatwas are preserved across international collections, including the Chester Beatty Library in Dublin, the Süleymaniye Library and Fatih collections in Istanbul, and Princeton University Library . The text was published early in Cairo by Idarat al-Matba'a al-Muniriyya within Majmu'at al-rasa'il al-muniriyya, and was later edited and published by 'Abd al-Mu'ti Amin Qal'aji .
