Diwan al-Ahkam al-Kubra, also known as al-I'lam bi-Nawazil al-Ahkam wa-Qatr min Siyar al-Hukkam (The Notification of Case Law Rulings and a Drop from the Conduct of Judges), is a fundamental compendium of Maliki applied jurisprudence and judicial rulings compiled by the Andalusian jurist al-Qadi Abu al-Asbagh Ibn Sahl (413–486 AH / 1022–1093 CE) .
Composition and Scope
The author began compiling the work on Saturday, 10 Muharram 472 AH . Having served as a court clerk, legal consultant (mushawar), and judge across several Andalusian and North African cities, Ibn Sahl aimed to organize disparate judicial cases (nawazil) and legal queries into a systematic thematic structure . In his introduction, he noted that he undertook the project to record the procedural conventions of the judiciary and the methods of legal consultation (mushawarat al-fuqaha') as practiced in Cordoba, where major juristic authorities and exemplars resided . Ibn Sahl also mentioned in the work that he had memorized both al-Mudawwanah and al-Mustakhrajah with meticulous precision .
The book functions as an empirical record of legal administration in eleventh-century al-Andalus, focusing on the actual responsa and court judgments issued by prominent Andalusian jurists rather than purely theoretical rulings .
Structure and Contents
The work is organized around standard legal and judicial themes, opening with an exposition on the nature of the judicial office (al-qada') and the differentiation of judicial authority from other public offices . Ibn Sahl delineates six distinct administrative jurisdictions operating in Andalusian governance:
- The judgeship (qada' al-jama'ah)
- The senior police (al-shurtah al-kubra)
- The junior police (al-shurtah al-sughra)
- The bureau of grievances (sahib al-mazalim)
- The office of appellate review (sahib al-radd), addressing cases doubted or remitted by judges
- The city prefect (sahib al-madinah) and market inspector (sahib al-suq / al-hisbah) .
Throughout the compendium, cases are cited alongside the specific fatwas and consultations of prominent Cordoban scholars, including Abu Abd Allah ibn Attab and Abu al-Mutarrif ibn Faraj . The text also includes a dedicated biographical section titled Tasmiyat al-fuqaha' wa-tarikh wafayatihim (Names of the Jurists and the Dates of Their Deaths) .
Reception and Scholarly Significance
The compendium is recognized as one of the earliest collections of Andalusian nawazil devoted specifically to Andalusian juristic fatwas . Biographers and legal historians, including Ibn Bashkuwal in al-Silah, characterized it as a highly relied-upon reference that judges and senior muftis depended upon in their judicial determinations .
Later Maliki authorities cited the work under variant titles: Ibrahim ibn Abd al-Rafi' referred to it as al-Ahkam, while Ibn Farhun cited it as al-Aqdiya . It is also frequently cited in Maliki literature as Nawazil Ibn Sahl or al-Ahkam al-Kubra .
Manuscripts and Modern Publications
Manuscripts of the text are preserved in several libraries, including the General Library and Royal Library in Rabat, the Qarawiyyin Library in Fez, and the National Library of Tunisia in Tunis .
The work has been edited and published in multiple modern editions:
- An edition prepared by Nurah Muhammad Abd al-Aziz al-Tuwayjiri (1415 AH) .
- An edition by Rashid al-Nu'aymi, published by Sharikat al-Safahat al-Dhahabiyyah (Riyadh, 1417 AH) .
- An edition edited by Yahya Murad, published by Dar al-Hadith (Cairo, 1428 AH) .
- An academic edition of its first part completed by Anas al-Alani at the Ez-Zitouna University in Tunis .
Additionally, the historian Muhammad Abd al-Wahhab Khallaf published several thematic collections of documentary records extracted directly from the manuscripts of the work, covering judicial topics such as criminal justice, dhimmis, market inspection (hisbah), and doctrinal disputes in Islamic Spain .
