Bayan al-Nasikh wa al-Mansukh min Ay al-Dhikr al-Hakim (Clarification of the Abrogating and Abrogated Verses of the Wise Remembrance) is a short treatise on Quranic abrogation (naskh) by the Mauritanian scholar Muhammad al-Amin al-Shinqiti (1325–1393 AH / 1907–1973 CE) . The text consists of a concise commentary on ten verses of poetry composed by Jalal al-Din al-Suyuti in his work al-Itqan fi 'Ulum al-Qur'an enumerating the abrogated verses of the Quran .
Composition and Transmission
The treatise spans approximately four and a half pages . It originated when al-Shinqiti authored a succinct explanation of the ten poetic verses in which al-Suyuti had gathered the twenty (or twenty-one) verses considered abrogated by verifying scholars . In 1372 AH, al-Shinqiti's student Atiyyah Muhammad Salim transcribed the commentary from his teacher's handwriting and read the text back to him .
Contents and Scope
The work addresses the individual rulings referenced in al-Suyuti's verses, identifying each abrogated passage alongside its abrogating counterpart or alternative exegetical opinions :
- Prayer and Fasting Rulings: Covers the turning toward the Qiblah in فَأَيْنَمَا تُوَلُّوا فَثَمَّ وَجْهُ اللَّهِ (Surat al-Baqarah: 115) as abrogated by فَوَلِّ وَجْهَكَ شَطْرَ الْمَسْجِدِ الْحَرَامِ (al-Baqarah: 144) according to Ibn Abbas; the prohibition of eating and marital relations after sleep during Ramadan; the expiation (fidyah) for fasting; and the night vigil prayer at the beginning of Surat al-Muzzammil .
- Legal and Social Injunctions: Examines the bequest for kin (Surat al-Baqarah: 180); the one-year waiting period for widows (al-Baqarah: 240); fighting during the sacred months; marital restrictions concerning fornicators (Surat al-Nur: 3); marriage regulations specific to the Prophet ﷺ (Surat al-Ahzab: 52); and offering charity prior to private consultation with the Prophet ﷺ (Surat al-Mujadalah: 12) .
- Jihad and Steadfastness: Discusses the ratio of steadfastness required in battle (Surat al-Anfal: 65–66) and the general command to march to war in انْفِرُوا خِفَافًا وَثِقَالًا (Surat al-Tawbah: 41) .
- Exceptions and Non-Abrogated Verses: Al-Shinqiti notes where abrogation is disputed or rejected, affirming that the verse on seeking permission for entry (Surat al-Nur: 58) and the verse on giving a portion of inheritance to visiting relatives and the poor (Surat al-Nisa': 8) are not abrogated, despite public laxity in practicing them .
Publication History
The commentary was appended to the concluding volume of al-Shinqiti's principal work of Quranic commentary, Adwa' al-Bayan fi Idah al-Qur'an bi-al-Qur'an . It was subsequently incorporated as the seventh lecture within his collected lectures (al-Muhadarat / Muhadarat al-Shinqiti) . It has been published alongside other short works by al-Shinqiti by Dar 'Alam al-Fawa'id, and in a separate edition edited by Ali ibn Muhammad al-'Umran and issued by Dar 'Ata'at al-'Ilm and Dar Ibn Hazm .
