Bayan al-Mukhtasar Sharh Mukhtasar Ibn al-Hajib (The Elucidation of the Abridgment: Commentary on Ibn al-Hajib's Abridgment) is a comprehensive commentary on legal theory (usul al-fiqh) authored by the Shafi'i theologian and jurist Abu al-Thana' al-Isfahani (674–749 AH / 1276–1349 CE) .
Base Text and Purpose of Composition
The work is an exposition of Mukhtasar al-Muntaha (commonly known as Mukhtasar Ibn al-Hajib), an abridgment authored by Ibn al-Hajib (d. 646 AH / 1249 CE) of his own larger treatise on legal theory and dialectics, Muntaha al-Su'l wa-al-Amal fi 'Ilmay al-Usul wa-al-Jadal . Al-Isfahani characterized the base text as concise in phrasing, rich in content, and focused strictly on the essential matters of the discipline .
In his introduction, al-Isfahani stated that his purpose in writing the commentary was to clarify the realities of the text, unravel its intricate phrasing, and disclose its underlying meanings . He adopted a balanced approach, avoiding excessive brevity that causes omissions as well as long-windedness that induces weariness, while aiming to resolve complex problems, establish foundational rules, and refute counter-arguments and doubts directed at the text's objectives .
Structure and Method
The commentary follows the thematic framework of Ibn al-Hajib's abridgment, dividing the discipline into four primary parts:
- Foundational Principles (al-Mabadi'): Discussing the definition, utility, and epistemological sources of legal theory, alongside logical and linguistic preliminaries, such as conceptual definitions (hudud) and affirmative propositions (tasdiqat) .
- Scriptural Proofs (al-Adilla al-Sam'iyya): Examining the textual sources from which legal rulings are derived, on the premise that rational intellect alone cannot independently determine legal obligations .
- Legal Preference (al-Tarjih): Addressing the methodologies for weighing and resolving apparent conflicts among probabilistic legal proofs .
- Independent Reasoning (al-Ijtihad): Detailing the qualifications, conditions, and operations required of a qualified jurist to extract rulings from detailed textual evidence .
Throughout the work, al-Isfahani explains the base text phrase by phrase, providing analytical definitions, logical demonstrations, and dialectical assessments of diverging juristic opinions .
Reception and Scholarly Standing
The commentary is regarded as one of the prominent classical expositions of Mukhtasar Ibn al-Hajib . It was numbered among the renowned "Seven Travelling Commentaries" (al-Shuruh al-Sab'a al-Sayyara) that circulated widely across the Islamic world, alongside commentaries by Qutb al-Din al-Shirazi, Badr al-Din al-Tustari, and others . Later scholars of legal theory, such as Akmal al-Din al-Babarti in his work al-Nuqud wa-al-Rudud, drew directly upon al-Isfahani's formulations when analyzing the base text . In modern print, the work has been edited and published in three large volumes .
