al-Tanqih al-Mushbi fi Tahrir Ahkam al-Muqni (The Satiating Revision in Verifying the Rulings of al-Muqni) is a manual of Hanbali jurisprudence by al-Mardawi (817–885 AH / 1414–1480 CE), composed as an abridged distillation of his expansive work al-Insaf to determine the relied-upon rulings of the Hanbali school .

Composition and Purpose

Al-Mardawi stated in his introduction that he extracted the corrections from his book al-Insaf fi Ma'rifat al-Rajih min al-Khilaf regarding the unresolved disputes (al-khilaf al-mutlaq) left unadjudicated by Ibn Qudamah in his foundational primer al-Muqni . His stated aim was to rectify unstated preferences, address instances where al-Muqni presented an unauthoritative position as definitive or sound, supply missing legal conditions (shurut) and qualifications (quyud), resolve ambiguous phrasing, and restrict overly general or unrestricted rulings .

Al-Mardawi completed the compilation on 9 Safar 878 AH according to his own colophon, though another report transmitted by Ibn Mani' mentions 16 Shawwal 872 AH . The author reviewed and collated the text multiple times, concluding his fourth collation on 3 Dhu al-Qa'dah 881 AH . Al-Mardawi noted that if anything in al-Tanqih contradicted al-Insaf or other works, al-Tanqih was to be relied upon as it was produced after thorough verification .

Method and Scope

The work is arranged according to the standard chapters of Hanbali jurisprudence in a single volume . Al-Mardawi restricted his text to points requiring correction or refinement, generally omitting issues in al-Muqni that already conformed to the relied-upon position of the madhhab . His method included:

  • Restricting unresolved multiple narrations or scholarly opinions to the sound position (al-sahih), often preserving Ibn Qudamah's original phrasing .
  • Replacing weak or non-predominant views with the authoritative position of the school .
  • Placing general chapter conditions at the start of sections, or weaving specific conditions and qualifiers directly into the original text .
  • Clarifying ambiguous legal rulings or terminology, and explicitly stating exceptions to general formulations .

Glosses, Combinations, and Editions

al-Tanqih al-Mushbi became a central reference for later Hanbali jurists, serving as the basis for several subsequent commentaries, glosses, and syntheses :

  • Marginal glosses (hawashi): Al-Mardawi penned his own marginal notes (hashiyah) onto his personal copy . Later glosses were authored by Musa al-Hajjawi (d. 968 AH), who recorded several rectifications and qualifications, and by Shihab al-Din Ahmad ibn 'Abd al-'Aziz al-Futuhi (d. 949 AH) .
  • Combined syntheses: Jurists integrated al-Tanqih with its parent text al-Muqni, including Shihab al-Din al-'Askari (d. 910 AH) in al-Manhaj al-Sahih fi al-Jam' bayn ma fi al-Muqni' wa-al-Tanqih, Shihab al-Din al-Shuwayki (d. 939 AH) in al-Tawdih, and Ibn al-Najjar al-Futuhi (d. 972 AH) in his authoritative reference Muntaha al-Iradat .
  • Editions: An edition prepared by Nasir ibn Sa'ud al-Salamah was published by Maktabat al-Rushd in Riyadh (1425 AH / 2004 CE), printing the work from al-Mardawi's autograph manuscript along with the author's own marginal notes (marked with the letter ha) and the Hashiyah of al-Hajjawi in the margin .
