al-Tamadhhub - Dirasah Nazariyyah Naqdiyyah (Adherence to a Legal School: A Theoretical and Critical Study) is an academic treatise on Islamic jurisprudence and legal theory (usul al-fiqh) by Khalid al-Ruwayti (Khalid ibn Mus‘id ibn Muhammad al-Ruwayti‘), published in 1434 AH (2013 CE) .

Background and Composition

The work originated as a doctoral dissertation submitted to the Department of Usul al-Fiqh at the College of Sharia in Riyadh, Imam Mohammad Ibn Saud Islamic University . The examination committee was chaired by supervisor Fahd ibn Muhammad al-Sadhan and included Ahmad ibn Muhammad al-‘Anqari and Muhammad Sa‘d ibn Ahmad al-Yubi . The author defended the dissertation on 24 Dhu al-Qi‘dah 1431 AH, receiving a doctorate with highest honors . It was published in three volumes by Dar al-Tadmuriyyah in Riyadh in 1434 AH (2013 CE) .

Purpose and Scope

The book examines the concept of tamadhhub (adhering to a specific school of Islamic jurisprudence, or madhhab) from both theoretical and critical perspectives . The author aimed to provide a comprehensive treatment combining jurisprudence and legal theory, clarifying the conceptual boundaries between tamadhhub and related notions such as imitation (taqlid), independent reasoning (ijtihad), following (ittiba‘), and partisan fanaticism (ta‘assub) . The study also investigates the legal rulings on following the four recognized Sunni legal schools, the conduct of an adherent when school rulings conflict with prophetic traditions, and the method of deriving rulings for contemporary novel legal issues (nawazil) .

Structure and Content

The work is divided into an introduction, two major parts, and a conclusion :

  • Introduction: Outlines the importance of the subject, rationale for selection, research objectives, a survey and critique of previous scholarly literature on madhhab adherence, research methodology, and difficulties encountered .
