al-Talqin fi al-Fiqh al-Maliki (Instruction in Maliki Jurisprudence), also known by the fuller title Talqin al-mubtadi wa-tadhkirat al-muntahi (Instruction of the Beginner and Reminder of the Advanced), is a legal manual of the Maliki school authored by the Iraqi jurist al-Qadi Abd al-Wahhab (362–422 AH / 973–1031 CE; reportedly born c. 349 AH) . It is one of the most widely circulated compendiums of the Iraqi Maliki tradition .
Method and Content
The work was structured as a concise legal manual (mukhtasar) designed to provide students with a clear and reliable summary of the school’s core doctrine . The author restricted the text to fundamental legal issues (ummahat al-masa'il) and the authoritative positions of the Maliki school, omitting explicit derivations of scriptural proofs as well as excessive sub-branches and conflicting internal transmissions .
The manual is characterized by precise, tightly formulated prose that incorporates subtle allusions to differing legal views from other schools without explicitly naming them, allowing beginner students to memorize established rulings while enabling advanced jurists to discern answers framed against counterarguments . The text follows the standard thematic order of legal compendiums, beginning with the book of ritual purity (Kitab al-taharah) and proceeding through ritual prayer (al-Salah), funerals (al-Jana'iz), almsgiving (al-Zakah), fasting (al-Siyam), pilgrimage rites (al-Manasik), marriage (al-Nikah), commercial transactions (al-Buyu'), and other areas of substantive law .
Reception and Scholarly Impact
Al-Talqin achieved widespread prominence across both eastern and western regions of the Islamic world . Jurists and biographical chroniclers evaluated it as one of the finest and most beneficial legal abridgments of the school despite its compact size . Shihab al-Din al-Qarafi identified al-Talqin as one of the five foundational pillars of Maliki jurisprudence upon which scholars across the East and West relied, alongside al-Mudawwanah, al-Jawahir, al-Tafri (by al-Jallab), and the Risalah of Ibn Abi Zayd al-Qayrawani . It was also cited extensively in later works, including Abu al-Walid al-Baji's legal commentary al-Muntaqa .
Commentaries and Editions
The text was the subject of numerous commentaries, supplements, and marginalia by later scholars:
- Al-Qadi Abd al-Wahhab himself began a commentary on his work titled al-Mu'in ala Kitab al-Talqin (or Sharh al-Talqin), though he left it incomplete .
- Abu Abd Allah al-Maziri (d. 536 AH) composed an extensive commentary, Sharh al-Talqin, which served as a major repository of comparative Maliki doctrine combining Iraqi and Qayrawani legal methodologies .
- Ibn Buzayzah al-Tunisi composed Rawdat al-mustabin fi sharh Kitab al-Talqin, focusing on elucidating difficult formulations and extracting overarching legal maxims in a more concise form .
- Ibn al-Munasif authored Fadl al-silm, dedicated to emendations and resolving obscurities within al-Talqin .
- Additional commentaries and notes were written by scholars including Ibn Muhriz al-Balansi, Abu Bakr Muhammad ibn Uthman al-Labbani, Dawud ibn Umar al-Iskandari, Ibrahim ibn Yakhlaf al-Matmati al-Tanasi, Nur al-Din al-Sanhuri, and al-Qalasadi .
The text was edited by Muhammad Thalith Sa'id al-Ghani and published in 1415 AH / 1995 CE .
