al-Talkhis fi Usul al-Fiqh (The Summary in Legal Theory), also referenced as Talkhis al-Taqrib, is a treatise on Islamic jurisprudence and legal theory by the Shafi'i jurist and Ash'ari theologian Abu al-Ma'ali al-Juwayni (419–478 AH / 1028–1085 CE), known as Imam al-Haramayn .
Background and Purpose
The work is an abridgment (talkhis) of al-Taqrib wa-al-Irshad fi Usul al-Fiqh by the Maliki-Ash'ari scholar al-Qadi Abu Bakr al-Baqillani (d. 403 AH) . Al-Juwayni composed the text during the early phase of his scholarly career, at a time when he was heavily influenced by al-Baqillani's thought and methodology in legal theory . Recognizing the vast length and discursive style of al-Baqillani's original work, al-Juwayni sought to condense it into a manageable reference prior to developing his own independent positions in legal theory .
Method and Content
In summarizing al-Baqillani's treatise, al-Juwayni focused on selecting the core theoretical issues (usul al-masa'il), pairing them with essential proofs and analytical weighing of opinions (tarjih) . The work systematically reflects al-Baqillani's early foundational contributions to the theological-juridical approach to legal theory (tariqat al-mutakallimin) .
Intellectual Significance
al-Talkhis stands alongside al-Burhan fi Usul al-Fiqh and al-Waraqat as one of al-Juwayni's principal works in legal theory . In scholarly comparisons across al-Juwayni’s intellectual development, al-Talkhis represents his early alignment with al-Baqillani's views, whereas his later works—specifically al-Burhan and al-Waraqat—contain numerous departures, rectifications, and independent stances that diverge from what he recorded in al-Talkhis .
Manuscripts and Publication
A primary surviving manuscript of the text is preserved in the al-Muzaffar Mosque in Taiz, Yemen (MS 314), with a microfilm copy housed at the Islamic University of Madinah (No. 1872) . The manuscript spans 210 folios at 25 lines per folio, written in a fine script with marginal collation notes, though suffering from some damage and missing folios at the beginning and middle .
al-Talkhis was edited by Abd Allah Ghulam al-Nibali and Shabbir Ahmad al-Amri and published in Beirut by Dar al-Basha'ir al-Islamiyyah and in Mecca by Dar al-Baz (1417 AH / 1996 CE) in a multi-volume print .
