al-Taliqa (Arabic: التعليقة, also referred to as al-Taʿlīq al-Kabīr or al-Taʿlīqa al-Kubrā) is an extensive work on Shafiʿi jurisprudence by the Khurasanian jurist and judge al-Qadi al-Husayn (d. 462 AH / 1070 CE), establishing the analytical framework of the Marw tradition (ṭarīqat al-Marāwaza) of the Shafiʿi school .
Composition and Transmission
The work originated as transcribed lecture notes (taʿlīqa) recording the juristic teachings and dictated legal analyses of al-Qadi al-Husayn in Marw al-Rudh . Contemporary accounts state that al-Qadi al-Husayn taught primarily from memory without reading from a written text, and when asked to author an independent book in jurisprudence, he remarked that his work was the transcript made by his student Abd al-Razzaq ibn Hassan al-Maniʿi, whose notes he reviewed and relied upon . Another prominent student who compiled his lectures was Abu al-Fath al-Arghiyani, regarding whom al-Qadi al-Husayn reportedly stated: "No one recorded my method as he did" .
Due to variations among the students who recorded these sessions, Jamal al-Din al-Isnawi observed that al-Qadi al-Husayn effectively possessed two distinct Taʿlīqas, each containing unique legal additions over the other . Al-Nawawi also pointed out that textual discrepancies occurred across its surviving manuscript copies, drawing a parallel to the textual variation found in the Taʿlīqa of Abu Hamid al-Isfarayini .
Content and Legal Method
Al-Taʿlīqa articulates the sub-school of Khurasan and systematizes positive law (furūʿ) through precise hypothetical cases and subtle legal distinctions . Biographers highlighted several of its rare and distinctive legal transmissions, including:
- A transmission from al-Bayhaqi stating an opinion of al-Shafi'i that omitting the repetition (tarjīʿ) in the call to prayer (adhān) invalidates it .
- The reporting of a position attributed to al-Shafiʿi that water does not lose its purifying quality when altered by clean substances .
- The juristic preference that praying while suppressing the urge to relieve oneself to the extent that concentration (khushūʿ) is lost invalidates the prayer, an opinion previously held by Abu Zayd al-Marwazi .
Reception and Influence
Al-Taʿlīqa served as a foundational source for later Shafiʿi literature in Khurasan . Al-Nawawi praised its breadth in Tahdhīb al-Asmāʾ wa-l-Lughāt, remarking on the abundance of its benefits and the vast number of practical legal branches derived within it .
Major classical reference works were directly adapted from it by his disciples:
- Al-Tahdhīb by Abu Muhammad al-Baghawi (d. 516 AH), which condensed and reorganized the material of his teacher's Taʿlīqa .
- Al-Tatimma by Abu Saʿd al-Mutawalli (d. 478 AH), which similarly functioned as an abridgment and refinement drawn from the Taʿlīqa .
The text was edited by Ali Muhammad Muʿawwad and Adil Ahmad Abd al-Mawjud and published by Maktabat Nizar Mustafa al-Baz in Mecca .
