al-Tahsil min al-Mahsul (The Derivation from "The Yield") is a treatise on Islamic legal theory (usul al-fiqh) by the Shafi'i jurist and scholar Siraj al-Din al-Urmawi (594–682 AH / 1198–1283 CE), composed as an abridgment of Fakhr al-Din al-Razi's landmark work al-Mahsul .
Background and Purpose
Al-Urmawi wrote the work in Konya, then the capital of the Seljuks of Rum . In the introduction, he states that he formally titled the book Tahsil al-Usul min Kitab al-Mahsul so that its name would correspond directly to its contents . Explaining his motivation, al-Urmawi noted that students' ambitions had waned, causing many to shy away from the expansive volume of al-Razi's al-Mahsul despite its great value . In response to requests from students seeking a manageable text to memorize, al-Urmawi abridged its wording while committing to retain all of its legal issues and types of evidence .
Method and Contents
While preserving the core framework of al-Mahsul, al-Urmawi incorporated his own additions and critical remarks (tanbihat) on problematic or obscure passages . He did not introduce opinions of scholars outside those cited in al-Mahsul, but he frequently flagged proofs he considered weak or vulnerable to counterarguments, occasionally substituting stronger proofs or merging related questions . His comments also adjusted certain attributions, such as phrasing opinions as belonging generally to the Hanafis rather than specifically to Abu Hanifa and his companions . His critical observations begin with the opening definitions of jurisprudence and legal terms, where he scrutinized al-Razi's phrasing and conceptual delimitations . In total, his explicit remarks and objections throughout the text number over eighty .
Reception and Commentaries
Haji Khalifa noted in Kashf al-Zunun that al-Tahsil became a well-known and widely circulated textbook among students of legal theory . It attracted significant attention from later legal theorists:
- Badr al-Din Muhammad ibn As'ad al-Tustari (d. 732 AH) composed Hall 'Uqad al-Tahsil to clarify difficult and condensed expressions in the text and address al-Urmawi's objections against al-Razi .
- Muhammad ibn Yusuf al-Jazari (d. 711 AH) authored a dedicated treatise responding to al-Urmawi's critiques, titled Ajwibat As'ilat al-Qadi al-Urmawi 'ala al-Tahsil .
- Jamal al-Din al-Isnavi (d. 772 AH) drew heavily upon al-Tahsil in his legal commentary Nihayat al-Sul .
Modern Editions
A critical edition of al-Tahsil min al-Mahsul was prepared by Abd al-Hamid Ali Abu Zunayd as a doctoral dissertation completed in 1398 AH and subsequently published by Mu'assasat al-Risalah in Beirut in 1408 AH / 1988 CE in two volumes .
