al-Tahqiqat ala Sharh al-Jalal lil-Waraqat (Arabic: التحقيقات على شرح الجلال للورقات) is a contemporary work on Islamic legal theory (usul al-fiqh) by the Yemeni scholar Fadl Murad (Abu Zakariyya Fadl ibn Abd Allah Murad) . The book serves as an analytical supercommentary and clarification of the classical commentary written by Jalal al-Din al-Mahalli (d. 864 AH / 1459 CE) on the foundational primer al-Waraqat by Imam al-Haramayn Abu al-Ma'ali al-Juwayni (d. 478 AH / 1085 CE) .
Purpose and Scope
In his introduction, Murad explains that he compiled the book's verifications and unique points from primary sourcebooks of legal theory to serve two main audiences: teachers presenting al-Waraqat and its commentary, and discerning students seeking clarity on issues directly pertinent to the text .
Methodology
Murad adopts several methodological principles in his exposition:
- Direct Documentation: Transmitting opinions and doctrines of the various legal schools directly from their authoritative primary sources without relying on secondary intermediaries .
- Critical Verification of School Positions: Re-examining and verifying the authentic positions of scholarly factions in matters where inaccurate stances had been historically attributed to them .
- Practical Application (Takhrij): Grounding substantive legal branches (furu') upon the underlying theoretical principles (usul), providing illustrative legal examples so that students grasp theoretical rules through concrete applications .
Publication
The work was published in its first edition by al-Dhahiriyya al-Rasikhun in Kuwait .
