al-Tahqiq fi Ahadith al-Khilaf (The Verification of the Hadiths of Juristic Disagreement) is a work of legal hadith criticism by the Hanbali scholar Ibn al-Jawzi (d. 597 AH / 1201 CE) . It evaluates and grades the prophetic traditions adduced as proof-texts in issues of disputed jurisprudence (al-khilāf), primarily extracting and examining the hadiths found in the juristic treatise al-Ta'liq (also titled al-Khilaf al-Kabir) by al-Qadi Abu Ya'la .

Title and Composition

The book is cited in scholarly literature under several closely related titles, including al-Tahqiq fi Ahadith al-Ta'liq, al-Tahqiq fi Masa'il al-Khilaf, and al-Tahqiq fi Masa'il al-Ta'liq . Ibn al-Jawzi relates in his introduction that during his youth, a group of his companions and teachers in jurisprudence urged him to assemble the hadiths cited in al-Ta'liq and determine which were authentic and which were flawed . He initially deferred the task due to his preoccupation with seeking knowledge and his assumption that existing juristic treatises were adequate .

Upon reviewing those works, Ibn al-Jawzi observed that most jurists possessed meager expertise in hadith, frequently depending on unauthentic reports, neglecting authentic ones, and unthinkingly imitating earlier authors . He identified three shortcomings among later scholars: indolence that led them to copy existing compilations without independent investigation; ignorance of where hadiths were located coupled with pride that prevented them from asking experts; and an exclusive focus on dialectical argumentation (jadal) and analogical reasoning (qiyās) to gain prestige, without regard for authenticating or critiquing traditions . He thus set out to present the Hanbali school's positions alongside dissenting opinions, impartially examining the transmitted evidence of both sides without bias .

Method and Scope

The work is organized according to the standard thematic chapters of Islamic jurisprudence, beginning with the book of purification (Kitab al-Tahara) . Ibn al-Jawzi introduces each legal issue with a direct heading—such as "Issue: Purifying water is that which is pure in itself and purifies other things"—and subsequently adduces the relevant hadiths through his own chains of transmission (asānīd) . He then provides critical analysis of the narrators, indicates defects in the chains or texts, and assesses their validity for legal deduction .

Reception and Subsequent Works

The work is regarded as a major reference for the critical evaluation of legal proof-texts (aḥādīth al-aḥkām) . The Hanafi traditionist al-Zayla'i relied extensively on it when compiling his hadith extraction work Nasb al-Raya .

Later scholars produced significant revisions and abridgments of the text:

  • Tanqih al-Tahqiq (also called Tanqih al-Tahqiq fi Ahadith al-Ta'liq) by Ibn Abd al-Hadi (d. 744 AH), who eliminated Ibn al-Jawzi's full isnads, attributed the hadiths directly to the primary compilers who recorded them, and added his own critical evaluations and corrections .
  • Mukhtasar al-Tahqiq by Burhan al-Din Ibrahim ibn Ali ibn Abd al-Haqq (d. 744 AH; another report gives 844 AH) .
