al-Tahdhib fi Ikhtisar al-Mudawwana (Abridgment and refinement of al-Mudawwana) is an influential legal compendium of the Maliki school by the Kairouanese jurist Abu Sa'id Ibn al-Baradha'i (completed 372 AH / 982–983 CE), condensing the foundational legal cases of Sahnun's al-Mudawwana wa-l-Mukhtalita .
Composition and Purpose
Ibn al-Baradha'i completed the work in 372 AH (982–983 CE) . In his introduction, he states that his aim was specifically to condense and refine the legal questions of al-Mudawwana and al-Mukhtalita because of their preeminent rank among legal compendia . He adopted a concise and abridged style rather than an expansive one, intending to stimulate students' diligence, facilitate rapid comprehension, and provide a reliable mnemonic aid for memory .
Method and Structure
Ibn al-Baradha'i organized the legal questions sequentially following the original order of al-Mudawwana, with only rare instances of presenting or deferring certain issues . His methodology is characterized by:
- Striving for comprehensive coverage of the rulings (masa'il) in each book of al-Mudawwana .
- Omitting redundant or repeated cases, formal introductory questions, and many cited traditions (athar) to avoid prolixity .
- Preserving the exact terminology and phrasing of al-Mudawwana rather than reformulating the text entirely in his own words .
- Verifying the transmission through his continuous chain of narration going back to Sahnun via Abu Bakr ibn Abi 'Uqba from Jabala ibn Hammud .
Al-Qadi 'Iyad observed that Ibn al-Baradha'i followed the abridgment method of his teacher Ibn Abi Zayd al-Qayrawani, while retaining the thematic order of al-Mudawwana and omitting the additional external rulings that Ibn Abi Zayd had introduced into his own abridgment .
Reception and Scholarly Impact
al-Tahdhib achieved immense popularity and became one of the standard instructional manuals across the Islamic West . Al-Qadi 'Iyad noted that students and scholars in the Maghrib and al-Andalus relied heavily upon its study and memorization . It became the primary basis for teaching and scholarly disputation in centers of learning such as Fez and across Sicily . Even when contemporary jurists in Kairouan shunned Ibn al-Baradha'i due to his ties with the Fatimid rulers, they made an exception for al-Tahdhib because of the prominence and utility of its legal material . Ibn Khaldun also recorded that jurists continuously maintained its study in their teaching circles .
Commentaries and Critiques
The text attracted critical engagement and numerous commentaries:
- Abu Muhammad 'Abd al-Haqq composed a treatise pointing out perceived errors and discrepancies where he argued Ibn al-Baradha'i had misrendered al-Mudawwana; al-Qadi 'Iyad defended Ibn al-Baradha'i against these criticisms, stating that the points of contention were merely verbatim quotes of Ibn Abi Zayd's wording .
- Ibrahim ibn 'Abd al-Samad ibn Bashir al-Tanukhi composed al-Tahdhib li-Masa'il al-Tahdhib .
- Shihab al-Din al-Qarafi wrote an extensive commentary titled Kifayat al-Labib fi Kashf Ghawamid al-Tahdhib .
- 'Ali ibn Muhammad al-Zarwili (al-Saghir) wrote a gloss entitled Taqyid Sharh Tahdhib al-Baradha'i 'ala al-Mudawwana .
- Ibn Naji al-Tanukhi wrote a commentary on the work (Sharh al-Tahdhib) .
