al-Riaya al-Sughra fi al-Fiqh (The Minor Care in Jurisprudence) is a legal compendium of Hanbali jurisprudence by Najm al-Din Ahmad ibn Hamdan (603–695 AH / 1206–1295 CE; another report gives his birth as 630 AH), composed as an abridgment of his expansive treatise al-Riaya al-Kubra .
Structure and Content
The work was structured into eight parts within a single volume and begins with the opening praise: "Praise be to God before every speech and ahead of every desire and petition" (الحمد لله قبل كل مقال وأمام كل رغبة وسؤال) . In Hanbali legal literature, the book and its parent work are collectively cited as al-Ri'ayatayn ("the two Ri'ayas") . Ibn Hamdan packed both treatises with rare and unusual transmissions (riwayat ghariba) that are scarcely gathered across standard texts of the school, drawing on his extensive reading and immersion in Hanbali doctrine . The author also produced an epitome of it titled Zubdat al-Riaya al-Sughra .
Reception and Critique
In Hanbali legal reference works, al-Ri'ayatayn are treated as notable sources for identifying sound school positions and legal preferences (al-tarjih); Ali ibn Sulayman al-Mardawi included Ibn Hamdan among the primary reference authorities for determining correct rulings in Tashih al-Furu' and al-Insaf . When Ibn Hamdan's statements differ between his two works, scholars give precedence to what he stated in al-Riaya al-Kubra .
The work also drew scrutiny from prominent Hanbali authorities. In al-Furu', Ibn Muflih warned that Ibn Hamdan occasionally presented an opinion as preferred where the issue ought to remain unresolved (mutlaq), left questions open where a definitive stance was warranted, and equated scenarios that are established as distinct or vice versa; he observed that scholars consequently hesitated to rely entirely on both Ri'aya texts, taking only what Ibn Hamdan explicitly clarified . Ibn Badran reiterated this critique, summarizing both books as unrefined (ghayr muharrar) and overly filled with rare transmissions .
Commentaries and Related Works
Several scholars composed commentaries and derivative works on al-Riaya al-Sughra:
- Muhammad ibn Abi al-Fath al-Ba'li (d. 709 AH) began an explanatory commentary on it, though he did not complete it .
- Shams al-Din Muhammad ibn Hibat Allah al-Barizi (d. 738 AH) authored a commentary titled al-Diraya li-Ahkam al-Ri'aya .
- Izz al-Din Abd al-Salam compiled an abridgment titled Mukhtasar al-Ri'aya .
- Muhibb al-Din Ahmad ibn Nasr Allah al-Baghdadi al-Tustari (d. 844 AH) authored a gloss (hashiya) on al-Ri'aya .
