Kitab al-Qada (The Book of Judicial Decisions) is an early compilation of traditions and rulings on judicature compiled by the Baghdadi hadith scholar and ascetic Surayj ibn Yunus (d. 235 AH / 849–850 CE) .

Transmission and Structure

The work was preserved through the transmission of Surayj's student, the Baghdadi traditionist Hamid ibn Muhammad ibn Shu'ayb (d. 309 AH) . In his bibliographic index al-Mu'jam al-Mufahras, Ibn Hajar al-Asqalani recorded his transmission of the second part (al-juz' al-thani) of the book through an isnad going back through al-Mizzi, Umar ibn Muhammad ibn Tabarzadh, Abu Ghalib Ibn al-Banna, and Ali ibn Umar al-Harbi to Hamid ibn Muhammad ibn Shu'ayb from Surayj ibn Yunus . Ibn Hajar noted that this preserved second part begins with the chapter concerning the insane person who deflowers a virgin (Bab al-majnun yaftaddu al-bikr) and concludes with the phrase ubiya bi-dhalika minha .

Scholarly Reception and Publication

The compilation was cited and utilized by later jurists in legal and judicial contexts, including Ibn Qayyim al-Jawziyya in his treatise on judicial policy and evidence, al-Turuq al-Hukmiyya . The text was edited and studied by Dr. Amir Hasan Sabri and published by Dar al-Basha'ir al-Islamiyyah in Beirut in 1421 AH (2000 CE) .
