al-Nubdha al-Kafiya fi Ahkam Usul al-Din (The Sufficient Epitome on the Rulings of the Principles of Religion) is a concise treatise on Islamic legal theory (usul al-fiqh) by the Andalusian scholar Abu Muhammad Ali ibn Ahmad ibn Sa'id ibn Hazm (384–456 AH / 994–1064 CE) . The text presents the foundational tenets of legal methodology and epistemology according to the Zahiri school .

Composition and Purpose

In his introduction, Ibn Hazm states that after completing his major, comprehensive work on legal theory—referring to al-Ihkam fi Usul al-Ahkam—in which he detailed the arguments and doubts of opposing viewpoints and established proofs against them, he resolved to summarize those principles in a concise manual (kitab latif) . His stated aim was to produce an easily accessible text that would be simple to comprehend and memorize, serving as an introductory stepping stone for students before approaching his larger treatise . Ibn Hazm also refers to this summary in his legal compendium al-Muhalla bi-l-Athar .

Method and Core Arguments

The treatise outlines the sources of legal authority and the rules governing religious obligation:

  • Textual Sources: Ibn Hazm maintains that legitimate legal verdicts, judicial judgments, and religious practice must derive exclusively from the explicit text of the Quran, authentic transmissions of the Prophet Muhammad's sunnah, or definitive consensus (ijma') . Every assertion of prohibition, obligation, or permissibility requires explicit scriptural proof (burhan) .
  • Scope of Consensus: The author restricts binding consensus to the generation of the Companions of the Prophet (Sahaba), arguing that the religion was completed during their lifetime and transmitted by them directly from the Prophet; subsequent generations cannot create new consensus where the Companions differed .
  • Legal Rulings and Fatwas: Ibn Hazm affirms that anyone who has verified knowledge of even a single issue directly from the Quran and Sunnah is permitted to issue a fatwa regarding that specific matter, whereas it is strictly forbidden to give rulings without direct knowledge .

Manuscripts and Editions

Manuscripts of the work are preserved in libraries in Turkey (Izmir Library, MS 764) and Germany (Berlin Library, MS 5376) . An extant manuscript copy concludes with a colophon by the copyist Ahmad ibn Abd al-Rahman ibn Abbas al-Hasbani, dated 787 AH .

The work has been published under variants of its title, including:

  • al-Nubadh fi Usul al-Fiqh: wa-huwa al-kitab al-musamma al-Nubdha al-Kafiya fi Ahkam al-Din, edited by Ahmad Hijazi al-Saqqa (Cairo: Maktabat al-Kulliyyat al-Azhariyya, 1401 AH / 1981 CE) .
  • al-Nubdha al-Kafiya fi Ahkam Usul al-Din, edited by Muhammad Ahmad Abd al-Aziz (Beirut: Dar al-Kutub al-Ilmiyya, 1405 AH / 1984 CE) .
